Henry Crushong Jr. called the meeting to order at 7:00 p.m.

MOTION by Schindel, seconded by Spence to nominate Dennis Robison for Chairman.  Motion carried.

Approval of December 2010 Planning Commission Minutes

MOTION by Santay, seconded by Spence to approve the December minutes.  Motion carried.

 

Guests:

Dr. Michael Yeager – Jesus is Lord Ministries – The church would like to convert the gymnasium into a 2-story homeless shelter and retreat center.  This would be a back-up shelter for the winter months when other local shelters are at full capacity.  Dr. Yeager also spoke of having a thrift store.

Our Zoning does permit “Churches and related uses” as a special exception when authorized by the Zoning Hearing Board in this zone.  We informed Dr. Yeager that he has several options.  He could ask for a zoning change to include a homeless shelter or he could call the Township and ask for a zoning hearing for a special exception.

 

Joe Dingus – Mr. Dingus inquired as to what we have been working on regarding his proposed development along Fairview Fruit Road and US Rt. 30.  We informed him that we are looking into making changes to our zoning and zoning maps and we are in the process of conducting zoning workshops. His project area is only one of many issues that need reviewed.

 

Darren Flake – Mr. Flake had questions regarding zoning changes.  What is the process of zoning changes and how will the sewer authority tie into zoning changes.

 

New Business:

Meeting with Adams County Office of Planning & Development – JR Crushong will set up an appointment with them to discuss the proposed text changes regarding Laurel Run.  He will call members with a date and time of the meeting.  We will then discuss their recommendations with the group at the next zoning workshop.

Zoning workshop – It was decided to have a workshop Wednesday, January 19th at 6 pm.  We are to return the zoning maps we were given with our concept of how the zoning map should be revised.

Zoning Workshop – January 19, 2011

 

Henry Crushong Jr. called the workshop to order at 6:00 p.m.

Gil Picarelli told the group that since Dominic Picarelli is more familiar with zoning issues he would be turning over the zoning workshop meetings to him.

 

Earlier today we had a meeting at 2 pm at Laurel Run to tour the area and review the plans.  Frank Gerhart and his team gave the presentation.  Members present were Matt Williams, Henry Crushong, Mary Lower, and Dennis Robinson.  Robert Thaeler of Adams County Office of Planning & Development (ACOPD) was also present.

 

JR Crushong gave the group present at the 7 pm meeting a review of the 2 pm meeting.

 

Robert Thaeler, ACOPD, will try to have recommendations available for us to review before the February 2nd meeting.

 

We reviewed the zoning map and decided to make some preliminary changes to the map.  We need to correct obvious mistakes, clean up zoning lines running through tract of land and make logical decisions as to where future development would be appropriate.  Dominic Picarelli will revise the map and bring copies to the next meeting for further review.

Approval of December 29, 2010 Planning Commission Minutes

MOTION by Spence, seconded by Williams to approve the December 29th minutes.  Motion carried.

 

Guests:

Frank Gerhart – Village of Laurel Run

They would like a “text change” to the zoning ordinance.  This would be to the Continuing Care Retirement Community (CCRC) section of the ordinance.  They are interested in building a 30 room apartment building approximately 65 +/- feet high which would not be allowed in the current ordinance.

We reviewed the recommendations from Rob Thaeler, Adams County Office of Planning and Development; Attorney Walton Davis and the revised proposed ordinance presented tonight from Mr. Gerhart.   We decided to remove section 4 from Attorney Davis recommendations.  The other issues was parking and we decided to have Parking for a CCRC – One (1) parking space for each five (5) beds in a Nursing, Skilled Care, Assisted Living or Personal Care Facility, plus one (1) parking space for each employee of the largest shift; and two (2) parking spaces per independent living one (1) floor dwelling unit, and one (1) parking space per two (2) dwelling units for a multi-story apartment building.

Robert Sharrah will revise the proposed ordinance changes and present to the Supervisors for their meeting.

MOTION by Williams, seconded by Lower to present the revised ordinance changes (parking, etc.) to the Supervisors for their approval.  Motion carried with Robinson abstaining.

 

Dan Colvin – current owner of the former Gary Sterner/Lovejoy property

Mr. Colvin would like a change to the ordinance to add a Conference Center/Retreat definition.  This definition would be a use by special exception in the Agricultural and Open Space Zone.  We reviewed the recommendations from Robert Sharrah.  After review we decided to have Sharrah revise section B on 175-44.1 which is the following: “The major improvements associated with the facility, including buildings, parking areas, etc., shall be setback a minimum of five hundred feet (500’) from all public road rights-of-way and perimeter property lines.”  We need to have this section revised since we are questioning the setback distance of 500’ as being too restrictive.  At the same time, since this an Ag zone we do feel a setback to keep the public away from active agricultural practices, i.e., spraying, etc., is necessary.  It may not apply so much in this instance but may be of concern in other areas of the Ag Zone.   Also we questioned the wording of “major” improvements.  What is a major vs. minor improvement?

We also would like Section G revised to state “In the event that a public facilities are available, or are made available, within one hundred fifty feet (150’) of the property building (replace the word property, with the word building), connection to these facilities shall be required.”

 

Robert Sharrah will make the recommended changes and forward to our solicitor, Wally Davis tonight.

MOTION by Williams, seconded by Lower to recommend approval pending the text ordinance changes have been revised.  Motion carried.

 

It was mentioned that we could combine the upcoming hearings, etc. for the text changes to the ordinance for the CCRC and the Conference Center/Retreat.  It was thought that this would be a good idea for cost savings.

 

Joe Dingus – Mr. Dingus inquired as to what we have been working on regarding his proposed development along Fairview Fruit Road and US Rt. 30.  He was looking for a time period of how long it would take to change a zoning map and we informed him that an estimate time frame would be 4 months, possibly longer.

 

Zoning Map Changes – Dominic Picarelli presented the revised zoning maps with the proposed changes shown.  We reviewed the map and made additional changes.  Dominic will return the updated maps to us for further review at the March meeting.

Approval of February 2011 Planning Commission Minutes

MOTION by Schindel, seconded by Spence to approve the February minutes.  Motion carried.

 

Guests:

Tim and Ryan Poe – Sketch plan – Orrtanna Rd. – Ag Zone

Ryan Poe has about 20 +/- acres on two adjoining tracts.  He would like to subdivide a one +/- acre lot off of one parcel and then combine the remaining acreage with his other tract as an adjoiner.   No problems seen with the plan.

 

Wess Fream – Mary A. Clapsaddle property along Poplar Springs Rd.

3.194 remaining acres.  He would like to put in 3 lots.  Gil Picarelli will check to see if he can put in 3 lots or if one of those will have to remain with the existing home.  He may only be able to have two lots.

 

Proposed Zoning Ordinance No. 2011-03 text for Conference Center/Lodge

We read the revised proposed ordinance presented at the meeting.

Concerns are the following:

  1. Remove this Use as a special exception in the Commercial Zone.
  2. Setback distance – Change minimum setback of five hundred feet (500’) to one hundred feet (100’).
  3. Impervious coverage – Change shall not exceed five percent (5%) to ten percent (10%).
  4. Clearing woodland – change it to No more than ten percent (10%) of the land area shall be cleared of forest or mature woods, etc.”
  5. Minimum lot size – reduced from 500 acres to 100 acres

 

MOTION by Williams, seconded by Crushong to recommend forwarding the ordinance to the Supervisors pending the above concerns have been addressed.  Motion carried.

 

Proposed Zoning Ordinance No. 2011-02 text for Continuing Care Retirement Communities

We read the revised proposed ordinance presented at the meeting.

Our prior concerns have been addressed by changes made to 175-45.1 Section D. 1 & 2

  1. The height of the highest accessible living floor shall not exceed thirty five (35’) above the elevation of the first (ground) floor of the building.
  2. Building construction types must contain specific fire separations between floor levels, living units and egress systems including corridors, stair towers and elevator shafts in accordance with the Pennsylvania Uniform Construction code (UCC) as stated in the International Building Code (IBC) 2009, or the most current applicable Code.

MOTION by Santay, seconded by Williams to forward the ordinance to the Supervisors.  Motion carried with Robinson abstaining.

 

Zoning Map Changes – Dominic Picarelli presented the revised zoning map with the proposed changes shown.  We reviewed the map and made additional changes.  Only a few minor changes need to be made: add the sliver along Rt. 30 near intersection (site of former nursery) to Commercial and add two properties along Flohr’s Church Road to Residential.  Dominic will try to have the revised map available for the Supervisors at their meeting tomorrow evening.

Approval of March 2011 Planning Commission Minutes

MOTION by Schindel, seconded by Santay to approve the March minutes.  Motion carried.

 

Guests:

Mary E. Scott – Final Plan – Hilltown Road – Residential zone

Subdivision of a 1.69 +/- acre parcel of land into two single family residential lots.  Each lot will host an existing single family dwelling.  The plan is considered nonconforming due to a portion of the existing dwelling on Lot 1 being located within the minimum side setback area.

Robinson read Adams County Office of Planning & Development’s comments dated 3/29/11 and KPI Technology’s comments dated 4/5/11.

Issue of concern:

When the proposed subdivision is completed both Lots 1& 2 will share the existing water well (on Lot 1).  While the plans shows an easement for the water line, the Township should consider if a maintenance /ownership agreement should be provided.

 

MOTION by Crushong, seconded by Santay to recommend approval of the plan pending resolution of the issue shown above.  Motion carried.

 

Mary E. Scott – Planning Module – Request of Planning Waiver & Non Building Declaration

MOTION by Crushong, seconded by Santay to approve the module.  Motion carried.

 

Randall Tenney – Sketch plan – Seven Stars Road

Mr. Tenney originally had 161.85 +/- acres.  He has approximately 32 +/- acres left to develop.  At this time he would like to subdivide about 10 of those remaining acres.

 

Nextel Tower – review a Zoning Hearing Board Special Exception application – along Rt. 234, Buchanan Valley Road – Harry P. Irvin is the property owner.

Nextel would like approval of a communication, transmitting & receiving facility.

Tower height with the attached lightening rod would be approximately 199’.

MOTION by Santay, seconded by Schindel to recommend approval of the application.  Motion carried.

 

Old Business:

Zoning Map Changes – Dominic Picarelli presented the revised zoning map with the proposed changes shown.  We reviewed the map and made additional changes.  Only a few minor changes need to be made:  along Fairview Fruit Road…the three (possibly four) lots along the road, three of which currently are occupied by residential homes be changed from the agricultural zone to residential zone.  The fourth lot does not have a permanent dwelling on it presently and needs to be investigated as to whether a perc test has been done on the property.  If so, then it should be made a residential lot, too.

Mr. Owen has 5.74 acres and would like to purchase 4.3 acres from the neighbor, Jim Pennington.  This would give him 10 acres and the ability to apply for Clean & Green.

No problems seen with the sketch plan.

 

Twin Springs Fruit Farm – Request for letter – Ag Zone

They would like to install a wood chip biomass heating system for the greenhouses and would like a letter of approval to apply for a grant for the project.  No problems were seen with the project.

MOTION by Crushong, seconded by Schindel to send a recommendation letter for approval of the project.  Motion carried with Robinson abstaining.

 

Paint the Wind LLC – Special Exception Application for Bed & Breakfast –1207 Flohrs Church Road

(Dalebrook Farm property)

They would like to operate a five suite Bed and Breakfast from the existing building on the property.

No problems were seen with the application.

MOTION by Spence, seconded by Schindel to recommend approval of the Special Exception.  Motion carried.

Approval of May 2011 Planning Commission Minutes

MOTION by Spence, seconded by Crushong to approve the May minutes.  Motion carried.

Dave Kuhn – Preliminary/Final Plan – Cashtown – Residential Zone

149 +/- acre parcel subdivision into two lots – Lot 1 is 40 +/-acres & Lot 2 is 109 +/- acres.  Robinson read Adams County comments dated 6/1/2011 and KPI Technology’s comments dated May 16, 2011.  The existing single family dwelling is located on Lot 2.

Concerns are the following:

  1. The deed reference to the adjoining lot owners appears missing.
  2. An executed owner’s acknowledgment needs to be provided.
  3. The Plan needs to show the existing streets with the cartway widths and right-of-way widths depicted.
  4. The proposed sanitary sewer line for Lot 2 needs to be shown on the plan.
  5. A proposed driveway with required and available sight distances and a clear sight triangle needs to be shown for Lot 1.
  6. It appears that the building setback lines do not match the numerical depiction (front setback lines).  They will move the front setback on Lots 1 & 2 from 10’ to 35’

 

MOTION by Lower, seconded by Crushong to recommend approval pending resolution of the above listed concerns.  Motion carried with Robinson abstaining

Twin Springs – Stormwater Management Plan

This is for the location on Chambersburg Road (US Rt. 30).  We have never seen any information on what changes are being made at this location.  We believe they should submit a Subdivision and Land Development plan.  Gil Picarelli will contact Twin Springs to advise them of this request.

MOTION by Crushong, seconded by Spence to request a Subdivision & Land Development plan.  Motion carried with Robinson abstaining.

 

Scooter’s Mountainside Tavern – Sewage Facilities Planning Module – Chambersburg Road

We reviewed the questions in Section 4A of the module.  We have a question regarding #15 and the neighboring property.

MOTION was made by Crushong, seconded by Santay to have the SEO check out the neighboring property so we can answer question 15 to the best of our abilities.  Motion carried with Robinson and Spence abstaining.

 

The Village of Laurel Run – Phase IIA – Special Exception application review – 6375 Chambersburg Road

They are requesting a special exception of the existing Mansion House additions/renovatios and one duplex expansion in the Continuing Care Retirement Community (CCRC).

They have adequate water and sewer.

MOTION by Crushong, seconded by Santay to recommend approval by the Zoning Hearing Board.  Motion carried with Robinson abstaining.

Approval of August 2011 Planning Commission Minutes

MOTION by Crushong, seconded by Schindel to approve the August minutes.  Motion carried.

 

Guests:

 

The Village of Laurel Run –Preliminary/Final – Phase IIA – Chambersburg Road

Robinson read KPI Technology’s comments dated 8/15/2011 and Adams County comments dated 9/7/2011.

Issues were the following:

  • The developer will need to provide copies of the current permit for water supply usage and         verified that the additional usage for the units with hydrants, sprinklers, etc. will be provided with adequate water.
  • Bonding of related improvements is required.
  • Owner’s acknowledgment needs to be executed.
  • FEMA approval of the submitted LOMA is required.
  • Additional information should be provided for the floodplain study.
  • Fill areas within the floodplain should be designed appropriately for such applications.
  • E&S and NPDES approvals are required.
  • Blanket easement should be acceptable in lieu of providing a 15’ access easement around all     stormwater management facilities.
  • Maintenance and monitoring agreement must be completed and executed.
  • PA DEP General Permit for Work in Waterways, Floodways and Wetlands is required.
  • Peak Rate Runoff Comparison tables should be revised with current data.

 

Bob Sharrah is meeting with the representative from PA DEP on Monday to discuss several of the issues above and will try to obtain a Non-riparian Buffer Waiver.

 

MOTION by Williams, seconded by Schindel to recommend approval of the plan pending resolution of the above listed issues and obtaining the Non-riparian Buffer Waiver from DEP.  Motion carried with Robinson abstaining.

 

General’s Mountain Lodge – Dan Colvin’s project

Bob Sharrah gave us an update on the project.  They would like to raise the bed of the road to prevent flooding at their expense and several other projects they would like to start before winter.  They will return for the October meeting.

 

7 year Review of ASA #2

Robinson read a letter from the Arendtsville Borough dated 8/30/2011 and the Adams County comments dated 8/19/2011.  ASA #2 is also adding two other farms – Hauser Family Farms and the farm owned by Tom and Jamie McGlaughlin

MOTION by Schindel, seconded by Crushong to recommend approval of ASA #2.  Motion carried.

 

Florence W. McDannell – request for plan review – Arendtsville Borough

We should send a letter of concurrence to the Arendtsville Borough that we approve of the plan.

 

New Business

Height restriction in Ag Zone

Currently there isn’t a height restriction in the Ag Zone because of barns, etc.  We were asked to consider whether we wanted to include a restriction on all non-ag buildings in the Ag Zone.

Bob Sharrah will return next month with  a plan regarding the installation of a woodchip burning building, greenhouse and propagation house on the property

 

James Pennington – Final Plan

No Adams County comments were received so the plan was tabled until next month

MOTION by Schindel, seconded by Crushong to recommend approval of the waiver.  Motion carried.

 

General’s Mountain Lodge – Final Plan – Flohr’s Church Road  – Ag Zone

Retreat lodge with parking spaces, access drive, stormwater management facilities and other amenities located on 633.73 +/- acre parcel of land.

Robinson read KPI Technology’s comments dated 10/4 and Adams County comments dated 10/4/11.

There were many issues discussed from both sets of comments.  Bob Sharrah stated that they will address the concerns listed on KPI Technology’s comments.  Main issues were the modifications that would need to be resolved.

Some of the modifications are the following:

  • Stormwater management – Bob Sharrah will be asking relief from this issue.
  • Road – will they need brought up to code? There is a box culvert concern – whether it should be made of concrete or aluminum.  How will the construction traffic be directed to the site? What are all the road improvements that need to be made?
  • Modification from paving the parking area and the access road will be needed.  No one has an issue with not paving those areas.
  • A letter from the mechanical engineer is needed stating that they meet the requirements to fight a fire.

 

There needs to be a brain-storming meeting with Bob Sharrah, the Township’s road master and the  Supervisors to discuss the road concerns.

 

MOTION by Santay, seconded by Williams to recommend approval pending the resolution of road concerns of the Township’s Road Master, resolution of KPI Technology’s issues and receiving a letter from the mechanical engineer stating their fire protection sprinkler system is adequate.  Motion carried.

Approval of October 2011 Planning Commission Minutes

Robinson noted the comments regarding the Douglas Nolan sketch plan were inaccurate on the October minutes.  Douglas Nolan already has a 4-unit apartment building on the site.  They are seeking to subdivide lot 8A off to make a building lot.

MOTION by Schindel, seconded by Spence to approve the amended October minutes as noted.  Motion carried.

James Pennington – Final Plan

Mr. Ray Owen has 5.74 acres and would like to purchase 4.3 acres from the neighbor, Jim Pennington.  Robinson read Adams County’s comments dated 10/6/2011 and KPI Technology’s comments date 10/17/11.  Issue:  The person receiving the lot addition shall record in the Recorder of Deeds Office of Adams County a memorandum that both parcels shall be considered as one single tract.

 

This issue was resolved by the addition of the following note on the plan: “Lot 2 shall to be conveyed to Ray Owen and shall become a permanent part of the Owens lands.  It may not be separately sold, leased, occupied, developed or otherwise used without the filing and approval of another subdivision or land development plan.”

 

MOTION by Crushong, seconded by Williams to recommend approval of the final plan.  Motion carried.

 

Twin Springs Fruit Farm – revised Sketch plan – Poplar Springs Road

Dynamic Hydra Pruners would like to install a bio-mass fueling facility for heat for greenhouses at their location – Twins Springs Fruit Farm      49.6 +/- acre lot

 

Ryan Morris Special Exception Hearing – 5400 Chambersburg Road – Open Space Zone

Application is for a law enforcement canine training facility and explosives storage facility.

After review of the information provided, the Planning Commission does not see a problem with having a kennel for a canine training facility in the Open Space Zone.  We do however have concerns with having an explosives storage facility at the site.  Some of our concerns about having an explosives storage facility deal with having two major gas lines located near the site and the devaluation of the existing neighboring properties.  Also we feel a Land Development Plan is required and how much of the tract is actually developable after the adjusted tract area is calculated to remove such areas as wetlands, steep slopes, setbacks, etc.

 

Although we do not have a problem having a kennel for a canine training facility, we feel an explosives storage facility would have a detrimental impact on the Open Space Zone.

Approval of November 2011 Planning Commission Minutes

MOTION by Crushong, seconded by Spence to approve the November minutes.  Motion carried.

Dynamic Hydra-Pruners – Orchard Road –  Ag Zone – Preliminary/Final Plan

The plan is for construction of two greenhouses, a pole building, a fuel storage building and an addition to an existing storage building with accompanying parking spaces, stormwater management facilities and other amenities located on 49.62 +/- acre parcel of land.

Issues were as follows:

  • An executed owner’s acknowledgment needs to be provided.
  • It should be noted if the proposed development is located within any flood prone areas.
  • The site data table indicates that private on-lot water and sewer services exist on-site. The location of these items should be shown/noted on the plan.
  • Approval of the E&S plan and an NPDES permit is required.
  • Bonding of related improvements is required. An estimate should be submitted for review.

They will ask the Supervisors for a waiver from the next two issues.

  • Parking facilities shall be surfaced with a durable bituminous or concrete paving material.
  • The access drive shall be paved at full width with a bituminous material.

MOTION by Schindel, seconded by Santay to recommend conditional approval of the plan pending the resolution of the issues shown above and if they obtain waivers from the Supervisors.   Motion carried with Robinson abstaining.

 

Generals Mountain Lodge – Final Plan

MOTION by Schindel, seconded by Santay to recommend approval pending resolution from FEMA, DEP & the waivers which were presented during the preliminary plan follow through to the final plan.  Motion carried.

 

Joe Dingus – Ag Zone – Guest

Mr. Dingus would like to pursue a cluster development in the Ag Zone.  He would have his own public water system and would need to hook up to the public sewer.  Suggested he apply of a zoning special exception for the cluster development.

Review Ag Security Area #1- seven year review

We reviewed the application with additions and modifications.

MOTION by Crushong, seconded by Spence to approve the 7 year review of Ag Security Area #1.  Motion carried.

 

Zoning Hearing Board Application – Gettysburg Area School District – Franklin Township Elementary School – Residential Zone

The applicants are seeking a special exception to add an addition to the Franklin Township Elementary School located in a Residential Zone.  Additional students have been relocated to the school this year which prompts the need for more classrooms.  The GASD states they meet zoning dimensional requirements and public school use is consistent with the residential neighborhood.

 

There are many prior issues with the GASD not fulfilling their financial obligations in paying their EDU’s and hookups to the Township’s public sewer system.

 

MOTION by Schindel, seconded by Santay to suggest the Gettysburg Area School District clear up their past encumbrances with the Township Sewer Authority before we entertain the thought of recommending approval of their special exception for the expansion.  Motion carried.

 

Application for Zoning/Land Use Permit for David Kuhn

Mr. Kuhn would like to erect a 30’ x 96’ x 12’ high tunnel on their property for the extension of the raspberry and blackberry growing season.

No problems seen with construction of the tunnel.
