Bill Knowles-Kellett – Sketch Plan – St. James Lutheran Church/Boy Scout Troop #79 – Mountain Rd.
The Scouts own approximately 10.25 +/- acres which surrounds a tract of 2.401 +/- acres which is owned by another lot owner. They would like to redraw the lot lines to keep their tracts together and have the other lot owner relocated to the one end of their tract instead of having them in the middle of their tract. No objection from the other lot owner.
The scouts would end up with approximately 10 +/- acres and the lot adjoiner would have the remaining acres.

MOTION by Deardorff, seconded by Redman to send to the Supervisors the proposed reformed zoning map and the proposed changes to the zoning ordinance. Motion carried.

It was decided to have one more zoning workshop. This will take place at 5pm on Thursday, April 3rd. If anyone can’t make it to the workshop that evening, they should pass any comments or questions to Dominic Picarelli before the day of the meeting.

Minutes of the Franklin Township Planning Commission Meeting

Approval of the March 19, 2014 Planning Commission Minutes
Gary Deardorff provided a motion to approve the minutes as presented; J R Crushong seconded the motion and the motion carried with unanimous approval.

New Business: Robert Sharrah presented a sketch plan for a proposed subdivision on Church Road, related to the former Margaret Burcham property. In order to obtain loan approval, potential new owners have until mid-October to gain approval for subdividing a 2-acre lot (Lot 4) with an existing home to Sally Rosensteel (Burcham daughter) as an existing stipulation of the Burcham will. Supervisor approval of the plan would be needed in October to meet this deadline. The 2-acre lot is to be sub-divided from the Lot 1 tract of 43+ acres. Lot 2 was previously subdivided for daughter Pam Hurlburt and Lot 3 on the east end was part of a prior subdivision and has its own parcel number.
Dominic Picarelli noted that the tract still falls under the 70/30 agricultural allotment and the remainder must be included in a table on the plan.
Mr. Sharrah noted the Clean & Green law still cuts off at 2 acres but the tax rollback on the 2 acres will need to be paid. Robert will return with the plan at the September meeting.
The Commission members had no issues with the proposed plan.
Michael and Pat Arendt own a mobile home where they live but rent the land from a family member. They would like to subdivide the land where the mobile home is located off the Irene Brent parcel at 719 Belmont Road. Looking at a map of the property, Chairman Robinson noted a landlocked piece of property could not be created. He recommended the Arendts use the private lane to the mobile home to develop a panhandle lot going to Belmont Road while meeting township specifications. Mr. Robinson also noted a subdivision may affect taxes if the property is enrolled in Clean & Green. Mr. Robinson encouraged the residents to look at possibly adjoining other tracts depicted on the map to the parent tract to avoid possible Clean & Green tax rollback penalties and other SALDO ramifications.
Dominic Picarelli noted that the proposed subdivision (panhandle) would be allowed; encouraged the residents to discuss potential Clean & Green issues with the County Tax Department; advised the residents to check with an engineer in regard to preparing a subdivision plan; and informed the residents that they may have to perform a perc test per township regulations on the remaining 10 acres.
Old Business: Dominic Picarelli provided an update on the new SALDO and Zoning Ordinance – looking at holding a joint hearing at the next Board of Supervisors meeting. Dominic also noted that the 45-day comment period for the Zoning ordinance has passed without receiving comments from the County. Dominic also noted that Township Solicitor Wally Davis questioned whether the Planning Commission had formally recommended the approval of the SALDO and Zoning Ordinance to the Board of Supervisors. In response, Gary Deardorff made a motion to approve the Zoning Ordinance and to send it to the Board of Supervisors for approval. Dennis Robinson provided a second and all the Commission members approved, with the exception of Bicky Redman, who abstained. Dominic noted he had made a few changes to the SALDO based upon comments from Solicitor Wally Davis. The revised SALDO was presented to Adams County for comments the previous Wednesday, starting the clock on the 45-day comment period. Dominic again noted that the Board of Supervisors could set up a hearing for both ordinances at their next meeting date. Gary Deardorff made a motion to approve the new SALDO and to send it to the Board of Supervisors for approval. Dennis Robinson provided a second and all the commission members approved, with the exception of Bicky Redman, who abstained.
Comments: Dennis Robinson inquired about the Morris property (Tripwire) court case. JR Crushong noted Morris lost the court case and the Township doesn’t have the authority to inspect the property.
William Cole also announced that he will be resigning from the Commission as he will be moving out of Franklin Township to Straban Township. JR asked for a written resignation.

MOTION by Crushong, seconded by Deardorff to approve the August minutes. Motion carried.

Margaret H. Burcham Estate – Preliminary/Final Plan – Church Road – Ag & Open Space zones
Subdivision of a 2 +/- acre parcel (Lot 4) from an existing 49.948 +/- parcel (Lot 1). Lots 1 & 4 will host the existing structures. Chairman Robinson read KPI Technology’s comments dated 9/16/2014 and Adams County Office of Planning and Development’s comments dated 9/15/2014.
Issues were: An executed owner’s acknowledgement needs to be provided.
MOTION by Redman, seconded by Deardorff to recommend to the Supervisors that they approve the plan. Motion carried.
Michael & Pat Arendt – sketch – Belmont Road
They are interested in purchasing the land (1.5 – 2 +/- acres) where they currently rent. We informed them last month they will need to show a 25” access panhandle for the landlocked parcel. They did check with the Tax Office and they will need to pay the rollback tax because the land is enrolled in the Clean & Green program. We suggested they proceed with obtaining the services of an engineer to draw a subdivision plan.
Old Business:
Vacancy on the planning commission: We will need to find a replacement for William Cole who resigned.
New Business:
Zoning Ordinance – There was a public hearing held this evening at 6 pm. We reviewed the comments from KPI Technology dated 9/17/2014 and Adams County Office of Planning and Development dated 8/26/2014. No one from the public attended the hearing.
MOTION by Deardorff, seconded by Redman to send the Zoning Ordinance changes to the Supervisors for their approval. Motion carried.

US Rt.30 runs through the property. There is an existing cell tower located on the property. They would like to take some acreage from Parcel 1 to add to Parcels 2 & 3.
This will be an addition to an existing lot. Under Section 307 of the new SALDO it will now have to be on one deed. They will need a non-building waiver.
