Approval of December 2007 Planning Commission Minutes

 

Guests:

Frank Gebhart – Sketch plan – Village of Laurel Run

He would like to subdivide 11 acres from 48 acres for bank purposes.  The property is commercial in front (Route 30) and open space behind.  It may prove problematic if they want to subdivide and then decide to build on residential later.

Planning Commission recommended talking to solicitor.

 

James Pennington – Final plan – New Road

MOTION by Robinson, seconded by Crushong to approve Preliminary plan pending recommendations of KPI comments made November 7, 2007.

  1. DEP approval
  2. Signature on owner’s acknowledgement
  3. Solicitor review of potential Right-of-Way plans
  4. Resolution of speed limit (is it 35 mph?) Paperwork is incomplete on traffic study.

MOTION  by Crushong, seconded by Spence to approve final plan.  Motion carried.

 

Tom Kalathus – mini-storage buildings – US Route 30

Hearing is coming up to extend time.  He would like a concrete retaining wall toward the back.  KPI had their structural engineer look at it.  He has to have a commercial building permit.

MOTION by Spence, seconded by Schindel to table the Preliminary/Final Land           Development plan.  Motion carried.

Comments on 7 year Ag Security Area.  Everyone was in agreement.

Approval of January 2008 Planning Commission Minutes

Misspelling of Frank Gerhardt’s name in the January minutes.

Would like to subdivide another lot off for step-daughter – they will still own the lot – Their concern was whether they could stay in Clean & Green

 

Montanna Wentz – Sketch plan – Cashtown-Orrtanna Road

57.68 +/- acres – there is one house already on the lot and they would like to subdivide another lot off but there is not enough frontage for another drive.  They could do a land development plan and put another house on the lot for a total of two houses on the one lot.

 

Harman and Linda Spence – Sketch plan – Hilltown Road

They have two houses on one deed – 12.78 +/- acres – Both of the houses are on Tract 2 – Would like to subdivide a one acre lot off (around the one house) of Tract 2

 

Tom Kalathas Land Development – Preliminary/Final Plan – Chambersburg Road – storage units

The Zoning Board approved the extension.  Reviewed KPI Technology’s comments dated 1/2/08 and Adams County comments dated 1/23/08.

Issues: Remove the billboard terminology and take off the wetland delineation on the plan.

MOTION by Robinson, seconded by Schindel to recommend approval of the plan as a final pending resolution of the issues shown above.  Motion carried.

Approval of February 2008 Planning Commission Minutes

Mistake noted on the Thomas Kalathas Land Development comments – the word “delineation” should be replaced with “note”.

Would like to subdivide two lots with one right-or-way.  He stated he has a right-of-way agreement that states he has access to two lots.  This isn’t clear on the map.  Suggested he come to the Supervisor’s meeting and speak with the solicitor.

 

Jeremy Davis – Sketch plan – (Harman and Linda Spence’s property) – Hilltown Road – Two houses on one deed – 12.78 +/- acres – Both of the houses are on Tract 2  – He would like to build a house on the 21 acres.  He would retain ownership to all the property.  Would like to show a 25’ panhandle on the plan that would give access to the 21 acres.

 

Linwood Verdier – Sketch plan – Old Rt. 30 – Open Space

3.75 +/- acres – The neighbor placed a structure on his property – He would like to sell 50’ to the neighbor.  Suggested he speak to Jim Temchack because he may have to go before the Zoning Hearing Board.

 

Robert Mahone – Preliminary plan – No County Comments

 

New Business:

It was suggested that whenever Jim Temchack is unavailable to attend a planning commission meeting that he provide notes or comments on any plans that are going to be brought up at the meeting.

Approval of March 2008 Planning Commission Minutes

MOTION by Robinson, seconded by Crushong to approve the March minutes.  Motion carried.

 

Guests:

Village of Laurel Run / Frank Gerhardt – Sketch plan – Rt. 30

They would like to relocate the main entrance to a more centralized location between the Assisted Living and the Nursing facilities.  This would mean a reconfiguration to the parking lot and creating a cul-de-sac.  A new drop-off canopy would be relocated and installed.

Based on the advice of the solicitor from an email dated 4/1/08 from Walton Davis to John White, suggesting that although a land development plan is needed in this case, an abbreviated land development plan might be the appropriate filing.

MOTION by Bush, seconded by Williams to recommend to the Supervisors that they accept a simplified land development plan showing impervious calculations, show end results, existing elevations, a note regarding new stormwater facilities not needed, etc.  Motion carried.

 

Robert S. Mahone – Preliminary plan – Buchanan Valley Road – Ag Zone

Subdivide a 1.102 acre single family lot from an existing 54.758 acre lot.

Merry read KPI Technology’s comments dated 3/4/08.  Issues were the following:

  • Concrete monument should be placed along a common lot line at the street right-of-way.
  • Sewage facilities planning approval is required.
  • A typical “PA One Call System” logo needs to be on the plan.
  • An executed owner’s acknowledgement needs to be provided.

MOTION by Williams, seconded by Schindel to recommend to the Supervisors approval of the plan pending resolution of the issues shown above.  Motion carried with Robinson abstaining.

Approval of April 2008 Planning Commission Minutes

MOTION by Crushong, seconded by Schindel to approve the April minutes.  Motion carried.

Sherry Turner – Preliminary/Final – Pine Valley Road – Ag Zone

Subdivision of 7.0 +/- acre lot from an existing 30.75 +/- acre parcel of land.

An extension was granted to this plan until 5/8/08.  Denny read KPI Technology’s comments dated 12/4/07 and Adams County Office of Planning and Development’s comments dated 12/20/07.

DEP hasn’t signed off on the sewage facilities planning module.

Issues are the following:

  • The minimum building setbacks for Lot 1 need to be shown on the plan.  This could be depicted on the Site Map.
  • The zoning officer’s comments should be considered.
  • It is recommended that a concrete monument be placed along a common lot line for every two lots.
  • While we agree with the proposed driveway accessing Pine Valley Road, a note should be placed on the plan that states a Highway Occupancy Permit is needed for any access toChambersburg Road.
  • Sewage facilities planning approval is required.
  • A typical Erosion and Sedimentation control schematic should be shown on the plan.
  • An executed owner’s acknowledgement needs to be provided.
  • This section precludes the development of residential driveways within 5 feet of property lines.  The proposed driveway for Lot 2 appears to be located approximately 3 feet from the proposed property line, although it is difficult to precisely determine this distance given the scale used for the drawing.

MOTION by Schindel, seconded by Crushong to recommend to the Supervisors approval of the plan pending resolution of the issues shown above.  Motion carried.

 

 

Robert S. Mahone – Final Plan – Buchanan Valley Road – Ag Zone

Subdivide a 1.102 +/- acre single-family lot from an existing 54.758 +/-acre lot.

Denny read KPI Technology’s comments dated 4/30/08.  The previous issues have been addressed to KPI Technology’s satisfaction.

MOTION by Crushong, seconded by Spence to recommend to the Supervisors approval of the plan.  Motion carried.

 

Robert S. Mahone – Sewage Module

MOTION by Spence, seconded by Schindel to approve the sewage module.  Motion carried.

 

Village of Laurel Run / Frank Gerhardt – Final plan – Chambersburg Road – located jointly in Commercial and Open Space Zoning Districts.

Proposal is to reconfigure the existing and drop-off area for the existing Assisted Living Center.  It appears that the number of parking spaces and the amount of impervious area will not change with this proposal.

Read Adams County Office of Planning and Development’s comments dated 5/5/08 and KPI Technology’s comments dated 4/30/08.

Issues are as follows:

  • It appears that the new parking spaces do not meet the minimum size standards (10 feet wide by 20 feet deep).  Also, the new physically handicapped parking spaces do not appear to meet the minimum size standards (13 feet wide by 20 feet deep).
  • Zoning officer’s comment should be considered.
  • The seal and signature of the engineer/surveyor responsible for the plan is required on all sheets of the plan to be recorded.
  • An executed owner’s acknowledgement needs to be provided.
  • Adams County Office of Planning and Development comments should be received, reviewed and considered.
  • The Owner should consult with Adams County Conservation District to determine if this project will require the review and approval of their office.

MOTION by Spence, seconded by Schindel to recommend to the Supervisors approval of the plan pending resolution of the issues shown above.  Motion carried with Robinson abstaining.

 

New Business

Proposed Ordinance 2008-04 (Parking ordinance and open space zone amend.)

Reviewed the proposed ordinance and recommend approval.

MOTION by Schindel, seconded by Crushong to recommend to the Supervisors approval of the ordinance as written.  Motion carried.

Jim Temchack is currently on medical leave.  Cindy Smith will be the acting code enforcement officer.  The township will be contracting out for the Building Code Enforcement.

Approval of May 2008 Planning Commission Minutes

MOTION by Spence, seconded by Robinson to approve the May minutes.  Motion carried.

The Village of Laurel Run – Sketch plan – US Rt. 30 – Open Space/Commercial Zone

George Desmond, co-owner and Larry Cottle were present to show the sketch plan.  The plan consists of 113 units to be built in 3 phases.  Sewer and water systems are already in place.  There is an entranceway, which will have to be revised to meet specs.  The 113 units will be comprised of cottages, villas and chalets.

Cottage – 1 total, 1 unit

Cottage – 6 total, 2 units per bldg =12 units

Cottage – 4 total, 2 units per bldg = 8 units

Villa – 8 total, 3 units per bldg = 24 units

Chalet – 2 total, 20 units per bldg = 20 units

Chalet – 4 total, 12 units per bldg = 48 units

113 units

Concern – The plan will need to go before the Zoning Hearing Board for a special exception.

 

Ernie Shriver – Sketch Plan – Oak Tree Drive – Ag Zone

120 +/- total acres  – in order to meet the Ag zone requirements they must keep 95 +/- acres in Ag.  There is an area on the plan that is in a flood plain and because of this they would like to have two 35-acre lots & one 25-acre lot to have a total of 95 acres.  In order to have the 25-acre lot they would need to go before the Zoning Hearing Board for a variance.  The remaining 23.775 +/- acres would be developed into 6 or 7 lots with deed restrictions to restrict future development.

Concerns:

  • Having two 35-acre lots and then creating a 25-acre lot instead of dividing the 95 acres into just two lots.  This will create one more homeowner and home site.
  • The right-of-way that is mentioned – does he own the land or is it just a right-of-way?  Is it wide enough?
  • To seek a variance he needs to show a hardship and we believe he’s creating his own hardship.
  • For the lots in the developable acres will he pay for the road?

Clair Sites – question – Cashtown-Arendtsville Road

15 +/- acres.  Has a long access strip to the property located between Knouse Fruitlands and the Hauser Winery – He would like to sell the property but wants to know if he could sell it as a buildable lot.  No house on the property at the moment.  Note on the 1998 plan about land to remain as a hunting property with no septic systems.  This note will need to be removed.  Not sure of the width of the access strip.  Suggested he speak to the Supervisors about the access strip since we feel that this is an existing lot.

 

Harman & Linda Spence – Preliminary Plan – Hilltown Road

Subdivision of a 3.509 +/- acre lot into a 1.07 +/- lot (lot 1) and a 2.439 +/- acre lot (lot 2).  Lot 2 will be conveyed to an adjoiner.  Robinson read Adams County comments dated 7/23/08 and KPI Technology’s comments dated 7/1/08.

Issue:  The Township Solicitor should review the driveway agreement for any comments unless field conditions warrant the existing alignment, a single, perpendicular access drive would be desirable.

Cindy Grove – questions

Wanted to know the date of the Ag Zoning ordinance which was October 1995.  Also had a question about her plan which has the 30% developable area shown on the plan.  She would like to swap an acre or two from one of the lots and give to another lot on the plan still keeping the 30%.  No problem seen with redrawing the lot lines.

 

Ernest R. Shriver Variance discussion

He purchased a 10.12 +/- acre lot that has a small house on it at present.  He would like to build a larger house on the lot and still keep the small house.  He was told he would need a land development plan.  There is an issue regarding the private drive since building another home on the property would add an additional property owner using the private drive as access.  We suggested he attend the Supervisor’s meeting and discuss it with them.

 

Ernest R. Shriver – revised sketch plan – Oak Tree Drive

120.587 +/- total acres – The Zoning Hearing Board denied his request for a variance.

The revised sketch shows lots as follows:  FM-1 has 35.92 +/- acres, FM-2 has 35.92 +/- acres, FM-3 has 35 +/- acres, FM-4 has 3.759 +/- acres, FM-5 has 3.615 +/- acres and FM-6 has 3.447 +/- acres.

No issues seen with the plan.

 

David Kuhn – Preliminary/Final plan – Old Route 30

Jamie Gebhart and Dan Arrison were present – they are purchasing 0.046 +/- acre from Dave Kuhn for an alleyway.  Reviewed Adams County comments and KPI Technology’s comments.  All issues were addressed.

David Kuhn – Request for Planning Waiver & Non-Building Declaration

Billboard between Old Route 30 and US Rt. 30 near McKnightstown – Biesecker property – Cindy Smith stated Jim Temchack approved the placement of the billboard on the property on 9/26/07.

Rita Harrison & Anthony Gabriel – Request for Special Exception – Chambersburg Road

The applicants are seeking a special exception for an auto repair and restoration shop in the Commercial Zone.  This property is adjacent to Trickl-eez along US Rt. 30.  The property was the former American Resin Casting establishment.  The township solicitor was consulted and he does not see a problem with the request as it has been submitted for a professional office use.  The plan does show living quarters and a medical office.

 

MOTION by Bush, seconded by Crushong to recommend approval of the special exception by the Zoning Hearing Board.  Motion carried.

Daniel Keyes property – There are now 3 dwellings on the property and we haven’t seen a land development plan.  Question was raised as to whether there was ever a permit granted for the original trailer.

Subdivision of 10.098 +/- acres into two single-family residential lots – Lot 1 – 3.002 +/- acres and Lot 2 – 7.297 +/- acres.

Merry read KPI Technology’s comments dated 10/3/2008 and Adams County comments dated 10/24/2008.

Issues are:

  • The zoning officer’s comments should be considered.
  • It is unclear what the original date of the plan is; the dates on each sheet of the plan are different and were not mandated by Township review/approval process.
  • An executed owner’s acknowledgement needs to be provided.
  • It is recommended that a street monument be installed along a common property line at the street right-of-way.
  • Sewage facilities planning approval is required.
  • A note should be added to the plan that states an approved stormwater management plan is required prior to issuance of a building permit.  The designer should review exemption criteria for possible exclusion of this requirement, with regard to peak rate control.

Approval of November 2008 Planning Commission Minutes

Motion by Robinson, seconded by Crushong to approve the November minutes.

SPECO—Preliminary plan—Gil reports they are still working on this

 

Marsh Creek, LLC.—Preliminary/Final—2 lot subdivision next to soccer field on Rt. 30—Subdivision of 10.098+  into two single-family residential lots—planning commission looked at this last month.  Gil says they have addressed all the issues.  Motion by Robinson to approve, seconded by Spence.  Motion carried.

 

Keystone Farms—Ernest R. Shriver—Preliminary/Final Plan—Oak Tree Drive—120.587+ acres.  Bob Sharrah, surveyor, said they have received a letter from the U.S. Fish and Boat Commission and are awaiting a letter from the U.S. Fish and Wildlife Commission regarding the land use.  Gil believes our solicitor should look at the shared driveway issue.  They have addressed all the other comments.  We have already signed off on the planning module.  Robinson made a motion to approve pending these and approval by DEP, seconded by Crushong.  Motion carried.

 

Eileen Keating—4 lot subdivision—Preliminary.  We saw this one year ago said Gil.  We are waiting for the planning module.  We still need owner’s acknowledgement and supervisor’s okay for a panhandle.  Also,  based on a letter scripted by former supervisor Hartley, there should be a 30 mile per hour limit along the road to compensate for the sight distance.  The supervisors would have to approve this also.  Motion to approve by Bush, seconded by Spence.  Motion carried.

 

Cashtown Community Park—22.385 acre—Preliminary/Final subdivision off Short Cut Road.  Former mill-race land addition of 0.239 acre to Lyndon LLC.  County is in agreement.  All KPI comments have been addressed.  Dennis Bishop presented the plan.   Motion to approve by Crushong, seconded by Spence.  Motion carried.

 

Wind Generators/Solar Panels—Schindel wondered if we have anything on record that could govern this in the future.  It was decided this would be brought up at tomorrow’s meeting with the supervisors and solicitor.
