The meeting, held at the Franklin Township Municipal Building, was called to order at 1:00 p.m. by Supervisor Ed Sharrah. The pledge of allegiance was recited by all in unison.
MOTION by Supervisor Arrison, seconded by Supervisor Crushong, to appoint Ed Sharrah as temporary Chairman. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Kathleen Franklin as temporary Secretary. Motion carried, 3-0.
REORGANIZATION
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to elect Jerry Arrison as Chairman of the Board. Motion carried, 3-0.
MOTION by Supervisor Arrison, seconded by Supervisor Sharrah, to elect JR Crushong as Vice-Chairman of the Board. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Kathleen Franklin as Secretary/Treasurer, setting the wage at $13.50 per hour. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to establish the Treasurer’s Bond at $600,000. Motion carried, 3-0.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to appoint Jeff Black as the Road Crew Foreman setting the wage at $17.80 per hour. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Curtis MacBeth and Dale Byers as full-time road crew employees setting the wages at $15.74 and $15.22 per hour, respectively. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Matthew Williams, Randy Pritt, Randy Fetter and Daniel Fetter and Dan Gebhart as part-time snow removal employees setting their wages at $15.00 per hour. Motion carried, 3-0.
MOTION by Supervisor Arrison, seconded by Supervisor Crushong, to appoint Land & Sea Services – Scott Merryman – as the Code Enforcement Officer. Motion carried, 3-0.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to appoint Land & Sea Services – Wilbur Slothour – as the Zoning Officer. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Walton V. Davis as the Township Solicitor. Motion carried, 3-0.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to appoint KPI Technology as the township’s engineering firm. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Gil Picarelli as the Sewage Enforcement Officer. Motion carried, 3-0.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to appoint Dominic Picarelli and Leah Heine as the alternate Sewage Enforcement Officers. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Judy Singley as Vacancy Board member. Motion carried 3-0.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to appoint William Cole for another term on the Franklin Township Planning Commission pending Planning Commission confirmation. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Wally Kane to the Municipal Authority for another term. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Mike Wassuta to the Franklin Township Municipal Sewer Authority for a one year term and to appoint Dale Byers to complete the term vacated by Ed Sharrah that ends in 2017. Motion carried 3-0.
After the vote, Solictor Davis explained that Mike Wassuta should be appointed for a 5 year term since the original 1 year term was only for the initial setup of the Water Authority.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah to change the previous motion to reflect a 5 year term for Mike Wassuta. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Kathleen Franklin as Open Records Officer. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to appoint Kathleen Franklin as the Pension Plan Chief Administrative Officer. Motion carried, 3-0.
MOTION by Supervisor Crushong, seconded by Supervisor Arrison, to appoint Ed Sharrah and Kathleen Franklin as Representative and Alternative Representative, respectively, to the Board of Directors of the York Adams Tax Bureau. Motion carried, 3-0.
MOTION by Supervisor Arrison, seconded by Supervisor Crushong to appoint Ed Sharrah and Jerry Arrison as Representative and Alternative Representative, respectively, to the Adams County Tax Collection Committee. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Jerry Arrison and Jeff Black as Representative and Alternate Representative to the Adams County Council of Government. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to establish PLGIT and Adams County National Bank as the depositories for Township funds. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to certify Jerry Arrison as PSATS State Convention Delegate and the Voting Delegate for Franklin Township and approve any incurred expenses as allowed by law. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve Land and Sea’s 2013 fee schedule. Motion carried, 3-0.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to approve KPI Technology’s 2013 fee schedule. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Arrison, to approve the IRS 2013 mileage reimbursement rate of 56.5¢ per mile. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to set the 2013 Board of Supervisors meetings for the first Thursday after the first Wednesday of each month at 7:00p.m with the exception of the July meeting which will be held July 11th. Motion carried, 3-0.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to establish the 2013 holidays observed for Township employees. Motion carried, 3-0.
There being no further business to conduct, the reorganizational meeting was adjourned at 1:20 p.m. and the regular meeting was immediately called to order.
REGULAR MEETING
APPROVAL OF MINUTES
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve the minutes for the meeting held December 13, 2012. Motion carried, 3-0.
APPROVAL OF BILL LIST #12
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to approve Bill List #12, General Fund checks 31108-31160 totaling $161,495.41. Motion carried, 3-0.
PLANS
Robert Sharrah requested that the request by Generals Mountain Lodge for a bond reduction be brought forward in the meeting and the supervisors agreed. They are requesting a reduction in the bond of $26,293.50. This will leave the bond balance as $23,980.00. The request is based on a recalculation of the figures used to establish the original bond. Gil Picarelli stated that he was satisfied that the new figures are in line with the balance of the project to be done.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong that the bond for Generals Mountain Lodge be reduced by $26,293.50, leaving a balance of $23,980.00. Motion Carried, 3-0.
McLaughlin – There was extensive conversation about the issues with both the 3 and 5 lot McLaughlin plans in regards to the Planning Commissions request for additional permits prior to approving them.
Robert Sharrah requested an extension to 4/8/2013 for the 3 lot McLaughlin plans.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve the extension to 4/8/2013 for the 3 lot McLaughlin plan. Motion carried, 3-0.
Mr. Sharrah requested that the planning modules for both the 3 and 5 lot plans be approved. Gil Picarelli has reviewed the plans and has no issues. The Planning Commission approved them.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve the planning module for the 3 lot McLaughlin plan. Motion carried, 3-0.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah to approve the planning module for the 5 lot McLaughlin plan. Motion carried, 3-0.
Mr. Sharrah also requested that the panhandles on the 5 lot plan be approved. They have already been approved by the Planning Commission.

REPORTS
Road crew foreman Jeff Black read the road report for December highlighting major equipment repairs, snow removal and installation of the speed limit signs for the changes that went into effect January 1. Supervisor Sharrah questioned who had purchased the signs located by the school. Jeff reported that the school had purchased them, but that the township installed them.
Supervisor Arrison stated that he had dealt with a complaint about a mailbox damaged during snow removal at the end of December. He said it was determined that the mailbox was too close to the road and improperly installed.
Supervisor Arrison read the report received from Buchanan Valley Fire Department. For 2012 they had a total of 232 responses and a total of 2194.48 manpower hours with no firefighter injuries or workers comp hearings. The report included copies of their 2013 roster and budget and a list of planned events. Supervisor Arrison also read the report received from the Cashtown Community Fire Department. They had a total of 237 calls for 2012 with 16 in December. Their report also included announcements of their 450 Club Feed to be held January 19th and the Annual Fair that will be held February 7-9, 2013.
Supervisor Sharrah read the zoning enforcement report. There was one cleared violation in December and eighteen cases remain open. The zoning enforcement officer reported he worked a total of 10.5 hours.
Supervisor Arrison reported on the COG meeting he attended 12/20/2012. He said the township will be getting involved with Pennbid. He also said that COG will be offering computer and internet training in conjunction with HACC. At the next COG meeting, there will be information provided about the GIS system and it may be something that would be beneficial for township secretaries to attend.

NEW BUSINESS
Lowell Ladd request for use of township roads for North South Marathon to be held April 28, 2013. Supervisor Sharrah reported that the concerns the township had after the 2012 marathon have been addressed and the insurance verification received.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve Lowell Ladd’s request for Township approval to use several Township roads for a marathon event to be held on April 28, 2013. Motion carried, 3-0.
GUESTS
Nancy McLaughlin questioned whether the fees for Land & Sea and KPI are hourly. Supervisor Arrison replied that some are and some are not for Land & Sea and gave her several examples. He stated that the average hourly rate for KPI is about $75/hr. Ms. McLaughlin requested that their fee schedules be kept available for view with the budget.

STORMWATER MANAGEMENT PLAN
REPORTS
Supervisor Sharrah read the road report for the month of January. Activities included maintenance and repair of equipment, and preparation for winter weather. Road crew was in several times during the month for snow and/or icy roads.
Supervisor Arrison read the Cashtown Fire Department report. Cashtown had 20 calls for January 2013. There were 10 responses in Franklin Township, 1 in Highland Township, 1 in Hamiltonban Township, 1 in Menallen Township and 1 in Bendersville Boro. Their annual fair will be held February 7-9. Supervisor Sharrah read a message from the Buchanan Valley Fire Company that stated that they were unable to complete a report for January due to computer problems.
Supervisor Arrison read the Code Enforcement Officer’s report. There was 1 cleared violation in January. Active violations include 10 for property maintenance, 2 for building maintenance and 5 for inoperable vehicles
Supervisor Sharrah read the Zoning Officer’s report for the month of January. There were a total of 9.25 hours worked, total UCC hours of 12, total code enforcement hours of 11.75 for a total hours worked of 33. There were 2 building permits issued for a total construction value of $72,400.00.

Sanford Quickel submitted a request for use of township roads for the South Penn Enduro to be held September 8, 2013. The secretary informed the supervisors that the insurance verification was received.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve Sanford Quickel’s request for Township approval to use several Township roads for the South Penn Enduro to be held on September 8, 2013. Motion carried, 3-0.
Gil Picarelli received a request from Robert Sharrah to request an extension for the McLaughlin 5 lot plan to April 5, 2013.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve the request for an extension for the McLaughlin 5 lot plan to April 5, 2013. Motion carried, 3-0.
GUESTS
Nancy McLaughlin asked about the pink flags in the field at the corner of Sycamore Lane and Route 30. Gil said that it is land belonging to another McLaughlin and that they probably indicate wetlands.
Bruce Strasbaugh thanked the Township for the contributions to the Cashtown Fire Department.
Joel Riddlemoser thanked the supervisors for decreasing the speed limit on Old Route 30 and said the impact has been positive. He mentioned that the ordinance is not yet on the website and is concerned that the website does not include all of the ordinances. Supervisor Sharrah said there will be a review to make sure that all ordinances are in the hands of the company that maintains that web page.
Don Herr questioned the absence of minutes from the website. The secretary assured him that all of 2012 is now online and apologized for the delay caused by the personnel transition.
Joan Reeve announced that an event called Prelude to Gettysburg is planned for June 29, 2013. Supervisor Arrison said that the planners are working with the Township to get the necessary permits.

McGlaughlin 5 lot plan – Gil Picarelli said that KPI had some items that need to be addressed prior to the plan being signed by the Supervisors.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve the McGlaughlin 5 lot plan contingent on items 1,2,4 and 5 in KPI comments letter being completed. Motion carried, 3-0.

STORMWATER MANAGEMENT PLAN
REPORTS
Supervisor Arrison gave a report from the last COG meeting. Results of the Emergency Services Study will be released the 15th. HACC is offering an Internet workshop open to all on March 15th from 1-4. The Joint Purchasing Bids submitted to PennBid in March will be open on March 28th. Most townships are experiencing an increase in workmen’s comp premiums due primarily to the Cancer Presumption Act. State Senator Alloway said he is working on legislation to provide funding assistance to local municipalities for activities in honor of the 150th anniversary of the battle of Gettysburg. Supervisor Arrison said the COG’s legislative priorities include trying to get funding for some of the 6500 current unfunded mandates, looking for legislative ways to attract and retain volunteer emergency personnel and reforming the prevailing wage law.
Supervisor Crushong read the Cashtown Fire Department report. Cashtown had 23 calls for February 2013. There were 14 responses in Franklin Township, 1 in Butler Township, 1 in Hamiltonban Township, 2 in Cumberland Township, 1 in Straban Township, 1 in Carroll Valley Boro, and 1 in Ardentsville Boro. There was also 1 in Quincy Township in Franklin County. They will be holding a Shrimp Feed on March 9th and a Ham and Cheese sandwich sale March 27th.
The secretary said that no report was received from Buchanan Valley Fire Department.

Activities included maintenance and repair of equipment, and preparation for winter weather, brush cutting along New, Bottom and Church Roads and cold patching pot holes on township roads. Road crew was in several times during the month for snow and/or icy roads.
Supervisor Arrison presented an article from Township News about emergency preparation and said that will be adding a link to the publication to its website.
OLD BUSINESS
NEW BUSINESS
Supervisor Arrison announced the townships plan to purchase a new Dodge truck to replace one purchased in 1996. Total cost will be $77,275.87 to be paid in 5 years by 5 annual payments of $17,386.35. Nancy McLaughlin questioned the supervisors as to whether the purchase is in the budget for 2013. Supervisor Sharrah told her that it is.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve purchase of a 2013 Dodge Ram 5500 truck to replace the Dodge 3500 purchased in 1996. Motion carried, 3-0.
The secretary requested that the township obtain a check card from Adams County National Bank to be used for those purchases where a credit card would normally be required. Supervisor Arrison explained that with the growth of the number of online transactions has come a growth in the number of places that prefer to be paid at time of order rather than via invoice. He also explained that Visa has safeguards in place to limit the amount that can be charged. Nancy McLaughlin questioned the use process and was assured that the card will reside in the office safe when not needed.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to approve the application to ACNB for a check card. Motion carried, 3-0.
The secretary said she has received a number of inquiries about the possibility of having the township zoning map displayed on the township website. Gil Picarelli said that KPI has the digital version and can work with the township’s website host to get it uploaded.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve putting the township’s zoning map on its website. Motion carried, 3-0.
A request was received from Joel Plotkin for the township to release the remaining $5,000 bond for Hundredfold Farm. All work was completed several years ago. Gil Picarelli agreed with this and said that, pending the final inspections to verify completion of the work, he saw no problem with the release.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve release of the remaining $5,000 bond for Hundredfold Farm, pending the inspection by KPI and payment of the KPI fee to perform the inspection. Motion carried, 3-0.
The township received a request from Hamiltonban Township to sign a written agreement with them to split the cost of work to be done on the Hickory and Moritz road bridges. The township already has an oral agreement to split the $2500.00 total cost.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve signature of the agreement with Hamiltonban Township to split the $2500 cost of repairs to the Hickory and Moritz Road bridges. Each township will pay $1250. Motion carried, 3-0.
Eugene Claybaugh submitted a request to the township for approval to use township roads for the South Mountain Antique Engine Association Show to be held May 4th and 5th. Wally Davis said to make sure the insurance certificate submitted by them names the township as an additional insured.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve use of township roads by the South Mountain Antique Engine Assoc during their show on May 4th and 5thpending receipt of the insurance certificate and a copy of the map of the route. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to appoint Gary Deardorf to the Planning Commission retroactively to February 6, 2013. Motion carried, 3-0.
Mr. Deardorf replaces Chris Santay whose term expires December 2014.
GUESTS
Nancy McLaughlin announced that the public is invited to attend a presentation on Agenda 21 to be held Thursday, March 21 at 7 P.M. at the Crosskeys Motor Inn Restaurant and Lounge. The event is being presented by Adams 912 Patriots, Cumberland County 9-12 Project and York 912 Patriots.

No action was taken on the Ron Bennett/Penn Forestry plan since it was tabled by the Planning Commission awaiting resolution of several issues raised by KPI. Joel Riddlemoser questioned what the plan will accomplish. Gil Picarelli stated that it is primarily a land swap.

Supervisor Crushong read the road report for the month of March. Activities included maintenance and repair of equipment, brush cutting for Hamiltonban Township, cold patching pot holes on township roads and repair of several road signs. Road crew was in several times during the month for snow and/or icy roads.
Supervisor Arrison read the Cashtown Fire Department report. Cashtown had 25 calls for March 2013. There were 17 responses in Franklin Township, 2 in Hamiltonban Township and 2 in Cumberland Township. There were also 2 each in Mont Alto Boro and Greene Township in Franklin County. They will be holding a 450 Club Feed/Drawing on April 20th.
Supervisor Arrison read the Buchanan Valley Fire Department Report. Buchanan Valley had 30 calls for March 2013 and a total of 160.04 volunteer man hours. They also put a new 2013 Special Unit in Service.
Supervisor Arrison gave a report from the last COG meeting. The Joint Purchasing Bids submitted to PennBid in March were opened on March 28th. There will be a meeting about the Fire Study on May 6th at 6:30 p.m. at the EMS building. The public works committee will hold a meeting on May 28th at 9:00 a.m. at Tyrone Township. The York Adams Tax Bureau reported they are doing well collecting taxes. Those working on the Adams County Connected project are pleased with their progress but want to continue trying to identify areas that are in need of improved internet service. There is a survey at their website – adamscountyconnected.com that is open to all. They would especially like to see additional large internet users take the survey.
OLD BUSINESS
Wally asked about doing a re-write of ordinance dealing with the front yar/corner yard issue. Joel Riddlemoser suggested defining types of residences to be covered. An example would be that a farm house set a long way from the road would be excluded. The supervisors asked him to do this.
Gil Picarelli reported on the Dollar General Meeting. He said that PennDot is ok with what they are doing other than widening the driveway. PennDot will not require a Traffic Study. Gil told the supervisors that the township may still want to do a study. He said that the developers asked about the need for an escrow account for the sewer authority and whether all bills can go to the township.
NEW BUSINESS
Gil Picarelli reported that Michaux Forest has plans for extensive changes to their firing ranges. Gil asked for and received approval from the board to send a letter telling them a stormwater management plan will be required and asking them to provide additional information about the project.
Wally Davis mentioned that he received a letter about towers that will be part of the Adams County Digital Emergency Radio System Project from John Hartzell. Although the letter references only towers to be located in Menallen Township, Mr. Davis told the Board that he explained in his response that the approval process for Franklin Township would be more complicated.
Supervisor Arrison announced the results of the joint purchase bid for stone in which the township participated. Supervisor Arrison gave three totals for material-only and delivered. The lowest cost for material-only is not the lowest for the township because we have it delivered.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve awarding the Stone Bid to New Enterprise (Valley Quarries) at the price of $46,098.00 which is the lowest delivered price. Motion carried, 3-0.
Supervisor Arrison announced the results of the joint purchase bid for line painting in which the township participated. Alpha Space Control’s price was only $13.20 higher than that submitted by MidAtlantic Marking and the township has an existing good relationship with the company.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve awarding the Line Painting Bid to Alpha Space Control at the price of $12,117.60. Motion carried, 3-0.
The supervisors noted that the bids for Seal Coating, Paving and Fuel still need to be awarded. Based on advertisement requirements, the bids need to go out as soon as possible with a due date of 5/1/2013. The bids can then be opened at the next BOS meeting.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to approve the advertising of the township’s invitation to suppliers to bid on Seal Coating, Paving and Fuel. Motion carried, 3-0.

STORMWATER MANAGEMENT PLAN
REPORTS
Supervisor Sharrah read the Code Enforcement Officer’s report. There were no cleared violations in March. Active violations include 11 for property maintenance, 2 for building maintenance and 4 for inoperable vehicles. Two letters were issued. There have been a total of four citations issued so far this year.
Supervisor Sharrah read the Zoning Officer’s report for the month of April. There were a total of 45 zoning hours worked, total UCC hours of 12 and code enforcement hours of 10.5 for a total hours worked of 67.5. There were 5 building permits issued for a total construction value of $292,000.00.
Supervisor Crushong read the road report for the month of April. Activities included maintenance and repair of equipment, brush cutting for Butler Township, preparing roads for seal coating, installing tile on Hilltown Rd., grass mowing for township building and sewer plant, and taking several units for state inspections.
Supervisor Arrison read the Buchanan Valley Fire Department Report. Buchanan Valley had 26 calls for April 2013 with a total of 96 calls for the year. They also conducted Joint Vehicle Rescue Review training with Fairfield Fire Department in which 17 of their members participated.
Supervisor Arrison read the Cashtown Fire Department report. Cashtown had 23 calls for April 2013. There were 14 responses in Franklin Township, 4 in Gettysburg Borough and 1 each in Hamiltonban, Highland, Arendtsville and Menallen Townships. There was also 1 Greene Township in Franklin County. They will be holding a Golf Tournament on May 3rd at Mountain View Golf Course.
Supervisor Arrison gave a report on the COG meeting held April 25, 2013. He reported that there is growing concern about the West Nile virus. The Adams County Conservation District will be spraying and encouraged COG members to work with residents to eliminate attractive breeding sites for mosquitoes. It was reported that Adams County received $143,000 of Act 13 Marcellus Shale funding that will be used for bridge improvements. There will be a meeting Monday, May 6th at the Emergency Services Center to discuss the results of the Fire Study. There will be a meeting on Tuesday, May 7th at Gettysburg Middle School to discuss 150th activities.
OLD BUSINESS
Prelude to Gettysburg – Representatives from the group running this activity shared information about the scheduled events. They have established a website detailing all of the activities, and have worked with Wilbur to help ensure that they have everything in place to ensure a safe and successful event. Saturday’s activities will run from 10 a.m. to 5 p.m. On Sunday morning at 9 a.m., a worship service will be held with period music and attendees invited to wear period clothing.
NEW BUSINESS
The supervisors discussed the Executive Session held before the meeting. The reason for the meeting was to discuss the ongoing lawsuit with Ryan Morris about his dog training facility. Mr. Davis stated that, while no action will be taken as a result of the Executive Session, the Township has no objections to the dog training facility provided Mr. Morris can meet all of the requirements. The biggest issue is Mr. Morris’ desire to warehouse explosives. The BOS is looking for certain items to be met for them to be stored in an area zoned open space. Solicitor Davis said that the Township is expecting Mr. Morris’ attorney Charlie Suhr to submit a draft of the ordinance required to allow this based on the fact that they have already been through the process to obtain Federal and State permits. Supervisor Sharrah reminded everyone that State and Federal permits do not preempt local ordinances. When asked what Mr. Morris’ plans are until the ordinance is in place and permits can be issued, Solicitor Suhr said that he plans to continue storing the explosives. Supervisor Sharrah stated that this would be asking the Board to look the other way while an illegal operation continues. All board members said they would prefer that Mr. Morris find alternate storage for the explosives until zoning issues can be resolved. Supervisor Arrison expressed concerns about any township liability that could result if Mr. Morris does not change his current operations until proper permits can be issued. Mr. Suhr assured the Board that all liability resides with Mr. Morris.
Gil Picarelli gave the Board a copy of the SALDO documents prepared and approved by the Planning Commission for their review and action at next month’s Board meeting.
The bids for Sealing, Paving and Fuel advertised after the last meeting were then opened. Supervisor Arrison read the various amounts bid and the results for the Sealing and Paving bids were determined. It was decided that the Fuel bid should be re-advertized and determined at the next meeting.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve awarding the Paving Bid to Valley Quarries at the price of $225,302.00 which was the lowest price. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve awarding the Seal Coat Bid to Hammaker East at the price of $184,349.95. Motion carried, 3-0.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to approve re-advertizing for fuel bids. Motion carried, 3-0.

Dale Byers questioned whether the Board has any interest in performing maintenance on the dirt roads in the township. Supervisor Arrison said it has not been discussed and Supervisor Crushong stated that he believes the grant money previously used for this maintenance is no longer available. Mr. Byers stated that he was told that Cumberland Township had found a source for funds. The Board told Mr. Byers that they would appreciate any information about available funds. Supervisor Crushong said that he will check with Cumberland Township and Gil Picarelli said that he also would check. Supervisor Sharrah asked Mr. Byers if he knew how much funding they are getting and he said about $35,000. Supervisor Sharrah said that this doesn’t sound like the source that Franklin Township previously used since the township only received in the $10,000 to $20,000 range.
Joel Riddlemoser stated that there is a zoning hearing board meeting scheduled for May 16th for the Dollar General Store. Solicitor Davis said that, if the Board needs him to attend the meeting, he will be out of the country on May 16th. There were further discussions about what the zoning hearing is about. Mr. Picarelli said that they are requesting a variance for the driveway, the number of parking spaces and signage. The BOS requested the secretary to notify the zoning officer of this and request that the meeting be rescheduled after May 26th so that Solicitor Davis can attend. The BOS expressed concern that they are always aware of zoning hearings and feel there is a need to improve communication about when these meetings will occur so that they can request Solicitor Davis to be present when they feel it is necessary. Supervisor Arrison said he will contact Mr. Slothour about informing the township when hearings are requested and prior to scheduling them so that the Supervisors can decide if they wish Solicitor Davis to attend.
Supervisor Crushong said that the Planning Commission is suggesting changing the date of their meeting to allow more time before the Board of Supervisors for communications. They are considering having their meeting two weeks prior to the BOS meeting. They will determine the new date and provide the information to the Secretary to advertize and make the necessary changes to the sign, website and other records as needed. Solicitor Davis reminded everyone that the 90 day clock starts on the day the plans are submitted, no matter when the meetings are held.

Arendtsville Borough sent plan to Franklin Township for review and comments. Gil Picarelli said that the planning commission waived their review because of the change being in Arendtsville Borough.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to concur with Arendstville Borough’s decision regarding the McDannell plan. Motion carried, 3-0.

Supervisor Arrison read the road report for the month of May. Activities included maintenance and repair of equipment, milling of shoulders on Hilltown Rd between Mummasburg Rd and Fairview Fruit Rd to widen road, helping Menallen Township with milling of their road, grass mowing for township building and sewer plant, and taking several units for state inspections. The road crew also supervised the seal coating of areas on several township roads: Bridgeport Rd, Pine Valley Rd, Poplar Springs Rd, Green Ridge Rd, Short Cut Rd, Flohr’s Church Rd, Oak Tree/Edward Court and Old Rt 30 behind Mr. Ed’s.
Supervisor Sharrah read the Zoning Officer’s report for the month of May. There were a total of 12.25 zoning hours worked, total UCC hours of 29 and code enforcement hours of 9 for a total hours worked of 50.25. There were 4 building permits issued for a total construction value of $82,800.00.

Supervisor Crushong read the Buchanan Valley Fire Department Report. Buchanan Valley had 22 calls for May 2013 with a total of 119 calls for the year. They also conducted an audit and site review for the last three Fire Grant Awards. There were no findings and the audits were closed for all three years.
Supervisor Crushong read the Cashtown Fire Department report. Cashtown had 17 calls for May 2013. There were 16 responses in Franklin Township and 1 in Menallen Township. They will be holding a 450 club feed on June 15th.
Supervisor Arrison gave a report on the COG meeting held May 23, 2013. He reported that HACC will hold another internet information session on July 11th. There will be a Secretaries’ Roundtable held on July 31st. He said that the Public Works committee is planning on holding a BYOB breakfast meeting Oct 2nd that will include a presentation on dealing with difficult people. It was reported that there was a light turnout for the primary elections but that all went well.
Solicitor Wilcox gave a report on the meeting held by the Zoning Hearing Board for the Dollar General Store project. He said that all requests for variances were denied. He told the Supervisors that the meeting did bring to light the necessity for a review of how the number of parking spaces required for an establishment should probably be done.
OLD BUSINESS
Michaux Forest – The secretary questioned whether there is to be any further action taken in light of the response received by Gil Picarelli to his letter about their plans to update their gun range. The Board asked Solicitor Davis to prepare a letter expressing their concerns about the appearance that stormwater regulations are not being followed by everyone in the Commonwealth.
NEW BUSINESS
Mouer – based on PC comments the consensus of the Board was that they agree with Mary Lower sending a letter to Robert Sharrah suggesting that they wait until the Planning Commission and the Board finish a zoning review. If they need immediate action, the letter should remind them that they will have to pay for the change.
Supervisor Arrison then announced that it is time for the renewal of the Land & Sea contract to provide zoning and permit services for the Township.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to accept the contract renewal for Land & Sea. Motion carried, 3-0.
The re-bids for Fuel advertised after the last meeting were opened. Supervisor Arrison read the various amounts bid and the result was determined.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve awarding the Fuel Bid to Shipley Energy whose bid per gallon was the lowest price. Motion carried, 3-0.
Supervisor Crushong announced that the Planning Commission voted at their last meeting to change their meeting date to the third Wednesday of each month beginning with July’s meeting which will now be held on the 17th. The time remains at 7:00 P.M.
MOTION by Supervisor Sharrah, seconded by Supervisor Arrison that notice of the meeting date change be advertized in the Gettysburg Times. Motion carried, 3-0.
Supervisor Crushong also said that the Planning Commission wants to revisit re-zoning to clean up some issues and plans to start this at the July meeting.

Nancy McLaughlin asked about the status of the PAWC sale. Supervisor Arrison replied that he knew of nothing new transpiring but suggested she might want to attend the Sewer Authority meeting on the 2nd Tuesday.
Solicitor Suhr, representing Ryan Morris, presented a draft of the ordinance that he had prepared, reviewed and revised with Solicitor Davis. He said the court has postponed the briefing schedule until August 12th and that the case can be put in the mediation program.The Board requested some additional revisions that Solicitor Suhr will incorporate into the ordinance. His thought is that the Planning Commission could hold the public hearing in July if both they and the county planning commission have completed their review. There followed an extensive discussion about the safety requirements and those dealing with emergency situations in the new ordinance should be adopted by Mr. Morris immediately. The Board told Mr. Suhr that it can only benefit Mr. Morris at a public meeting to be able to say that the practices are already in place. He also said that Mr. Morris has reduced the stored explosives to 60% of what was there originally. All of the Board members told Solicitor Suhr that they would like Mr. Morris to start meeting the requirements of the proposed ordinance. Supervisor Sharrah reiterated that the Board would like to see a further reduction in the stored explosives until such times as the ordinance would be approved.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong that the secretary send a copy of the revised ordinance to both the Township and County Planning Commissions. Motioned carried, 3-0.

Activities included maintenance and repair of equipment, installing and shooting oil along the berm on Hilltown Rd section that was widened, grass mowing for township building and sewer plant and installation and/or replacement of signs at various locations. The road crew did the bore and pipe under Orchard Road for the sewer line across the road.
Supervisor Arrison read the Buchanan Valley Fire Department Report. Buchanan Valley had 18 calls for June 2013 with a total of 138 calls for the year. They hosted “Save Your Own” training and members put in over 240 hours of life saving training in one weekend. The fire department also placed in service a new thermal imaging camera and Large Area Search Kit.
Supervisor Crushong read the Cashtown Fire Department report. Cashtown had 26 calls for June 2013. There were 20 responses in Franklin Township, 1 in Straban Township, 1 in Gettysburg Boro, 2 in Cumberland Township, 1 in Fairfield Boro and 1 in Quincy Township in Franklin County.

He reported that surveys regarding Economic Development in Adams County have been sent out to municipalities, residents and businesses. He said that the Public Works committee reminded everyone about the BYOB breakfast meeting Oct 2nd that will include a presentation on dealing with difficult people. He also said that Penn State Extension will have a representative attend a Tyrone Township meeting on sewer and that they can offer the same service to other townships.
Brandon Guiher reported that KPI received a bond from Sprint in regards to the Sprint Nextel Cell Tower that is to be erected. He said that KPI still had some minor comments that Sprint needs to address.

Supervisor Crushong reminded everyone about the new meeting date for the Planning Commission. Effective this month, they will meet on the third Wednesday.
NEW BUSINESS
As a result of having variances denied by the Zoning Hearing Board, Mike Swank of SEI asked the Board to consider a review of the parking requirements formula in the current ordinance. One of the changes he suggested was that the formula be applied only to planned retail square footage. The current formula is applied to total square footage, including storage space not open to customers. He also asked the Board for feedback on the idea that spaces required by the current formula be allowed to be shown on the plans, but not actually built until the need for them is demonstrated. Solicitor Davis said that the ordinance will have to be amended to allow either of these changes. He said that, even though Dollar General may not require the mandated spaces, a different future owner might. Supervisor Arrison asked if the ordinance could be written so that a future sale of the property would trigger a re-evaluation of space requirements. Solicitor Davis said that the Township can request the attorney for Dollar General to write a letter documenting they can demonstrate that they do not need the number of spaces currently required. Their attorney would also provide a draft of an ordinance allowing this. The Township will also need to get Dollar General’s concurrence to pay for all charges associated with the change. Supervisors Crushong and Arrison suggested that Mr. Swank ask his client if he is willing to pay to have their attorney talk to Solicitor Davis to clarify how their request should be processed. Mr. Swank said he had no problem making that request. Solicitor Davis told Mr. Swank this process could present a significant delay in getting final approval. Mr. Swank requested an extension for the plan from 7/11/2013 to 10/11/2013.
MOTION by Supervisor Crushong, seconded by Supervisor Arrison to approve an extension from 7/11/2013 to 10/11/2013 for the Dollar General plan. Motion carried, 2-0.
The secretary asked if anything had been done with the SALDO documents given to the Board. Solicitor Davis asked if the documents had been sent to Adams County also and Brandon Guiher replied that they had. The Supervisors plan on reviewing the documents prior to the next meeting.
Bid documents for the Waste Contract were received and needed to be approved by the Supervisors prior to the Bid Advertisement being done by the County.
MOTION by Supervisor Crushong, seconded by Supervisor Arrison that the Waste Contract Bid Package be approved to be advertized by Adams County pending revision based on comments by Solicitor Davis. Motion carried, 2-0.
The Township received a copy of an amendment to the PAWC sale contract. The amendment changes the terms of the contract from a lease/purchase to an outright purchase of the Sewer system.
MOTION by Supervisor Crushong, seconded by Supervisor Arrison that the amendment to the PAWC sales contract for the sewer system be approved. Motion carried, 2-0.
The Board received correspondence from the Sewer Authority requesting removal of a lien against Charles and Nancy Pritt at 3261 Chambersburg Rd. Solicitor Davis said that he will take care of this if the Board releases the lien.
MOTION by Supervisor Crushong, seconded by Supervisor Arrison that the lien held against the Pritt property at 3261 Chambersburg Rd. be released. Motion carried, 2-0.
The Township received a proposed resolution for a Small Flow Treatment Facility on a property owned by Marvin Maybury at 2475 Mummasburg Road. Mr. Maybury purchased the property recently from the estate of the former owner, Joan Maloney, but the sale has not yet been recorded. Solicitor Davis said that the document cannot be signed until we are assured that all parties required to sign have done so and until the recording information can be provided.
MOTION by Supervisor Crushong, seconded by Supervisor Arrison that the Small Flow Treatment Facility resolution for 2475 Mummasburg Road (Parcel # 12E10-00069—000) be approved pending review and approval by Solicitor Davis of completed document. Motion carried, 2-0.

Nancy McLaughlin asked for clarification of the purchases reported by the Buchanan Valley Fire Department. Supervisor provided her with additional information about the equipment and what it is used for.
Tom Kerr asked about possible changes in sewer hookup fees once the sale to PAWC is completed. Solicitor Davis told him that once the sale is closed, the Township will have no part in those decisions. Solicitor Davis also told him that PAWC may not be subject to the same rules establishing these fees as the Township has been.

STORMWATER MANAGEMENT PLAN
REPORTS
Supervisor Sharrah read the Zoning Officer’s report for the month of July. There were a total of 4.25 zoning hours worked, total UCC hours of 16 and code enforcement hours of 14.25 for a total hours worked of 34.5. There were 3 building permits issued for a total construction value of $81,000.00.
Supervisor Sharrah read the Code Enforcement Officer’s report. There were 3 cleared violations in July. Active violations include 4 for property maintenance, 1 for building maintenance and 5 for inoperable vehicles. Four letters were issued. There have been a total of 9 citations issued so far this year.
Supervisor Arrison read the road report for the month of July. Activities included maintenance and repair of equipment, cleaning leaves from ditches along several roads and grass mowing along roads and for township building and sewer plant. The road crew also helped Menallen and Butler Townships with seal coating, removed downed tree limbs after storms and did some repair work on Flohrs Church Road.
Supervisor Arrison gave a report on the COG meeting held July 25, 2013. He reported that the Township secretary attended training on the new Pictometry system the County will be using in addition to the current GIS system. Rusty Ryan from the County Conservation Districe will be sending requests for feedback from Municipalities that have adopted new stormwater ordinances pursuant to ACT 167.
Supervisor Arrison read the Buchanan Valley Fire Department Report. Buchanan Valley had 18 calls for July 2013 with a total of 156 calls for the year. They conducted their Annual Fire Prevention display at Caledonia State Park.
Supervisor Arrison read the Cashtown Fire Department report. Cashtown had 29 calls for July 2013. There were 20 responses in Franklin Township, 2 in Gettysburg Boro, 1 in Highland Township, 2 in Hamiltonban Township, 1 in Arendtsville Boro, 1 in Bendersville Boro and 2 in Quincy Township in Franklin County.
Gil Picarelli reported that KPI received a bond from Sprint in the amount approved by KPI for the Sprint Nextel Cell Tower that is to be erected.

Ordinance for Storage of Explosives – a date needs to be set for a hearing to review the proposed ordinance that provides regulations for the storage of explosives.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to set a hearing date of September 5, 2013 at 6:30 p.m. for the proposed Storage of Explosives Ordinance. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve the advertisement of the hearing date and time twice in the Gettysburg Times. Motion carried, 3-0.
Donna Byers presented information on Cashtown Community Day, to be held September 7, 2013. The day will start with a 5k run from 6-9 a.m. and end with a DJ from 4-8 p.m. Activities will include a parade at 1 p.m., games, storytelling, hayrides and a picnic at 4 p.m. Ms. Byers invited the Supervisors to come out and mingle with the townspeople. She also requested permission to close Old Route 30 from the edge of McKnightstown to the Cashtown Fire Department for the parade and other activities. Supervisor Sharrah asked Ms. Byers to put the road closure request in writing including details of the 5k run and have someone from the Fire Department also sign the request. The Supervisors indicated that final approval will be voted on at the September 5th meeting. Supervisor Arrison requested that the Township Secretary post the event on the Township website.
GUESTS
Mary Grimes said that there is a plastic pipe at the end of her drive that is full of leaves. Supervisor Sharrah reminded everyone that it is the landowner’s responsibility to keep the pipes open. She also mentioned that there appears to be a lack of communication on Township issues. She wondered what had happened to the Township Newsletter. Supervisor Arrison said that he did not know why it had been discontinued, but he did know that it was expensive to produce and distribute. He mentioned that the Township is looking at ways to update the website using more modern user friendly software.
Willie Hechman said that since the minutes can’t be published on the website until they are approved at the following month’s meeting, could the agenda for the current month be published asked if the agenda could be published on the website? The Supervisors said that the agenda sometimes changes up to and including the day of the meeting, but that the secretary should be able to post the proposed agenda prior to the meeting.

The purpose of the meeting was to adopt a resolution picking a supervisor to attend the closing of the sale of the sewer system to PAWC on Thursday, August 29th and to authorizing that supervisor to sign all closing documents on behalf of the Township.
MOTION by Supervisor Sharrah, seconded by Supervisor Arrison to authorize Supervisor Arrison to attend the closing for the sales of the sewer sytem to PAWC on Thursday, August 29, 2013 in Hershey, PA and sign all closing documents on behalf of Franklin Township. Motion carried, 2-0.
Secretary Franklin also noted that the Township received a request from Greene Township requesting Franklin Township to provide authority for their Fire Police to assist at the Fayetteville Volunteer Fire Department’s Carnival and Parade, September 11-14, 2013.

REPORTS
Supervisor Sharrah read the Zoning Officer’s report for the month of July. There were a total of 10 zoning hours worked, total UCC hours of 18 and code enforcement hours of 13.75 for a total hours worked of 41.75. There were 4 building permits issued for a total construction value of $157,400.00.
Supervisor Sharrah read the Code Enforcement Officer’s report. There were no cleared violations in July. Active violations include 10 for property maintenance, for building maintenance and 5 for inoperable vehicles. There have been a total of 9 citations issued so far this year.
Supervisor Arrison read the Cashtown Fire Department report. Cashtown had 24 calls for August 2013. There were 17 responses in Franklin Township, 2 in Hamiltonban Township, 1 in Biglerville Boro, 1 in Bendersville Boro, 1 in Butler Township and 1 in Fairfield Boro. They will be holding Community Day Saturday, September 7th and a Golf Tournament September 28th at Mountain View Golf Course.
Supervisor Arrison read the Buchanan Valley Fire Department Report. Buchanan Valley had 19 calls for August 2013 with a total of 175 calls for the year. Eighteen firefighters completed the new Hands Only CPR training. They also placed a new County Accountability System in effect.
Supervisor Arrison read the road report for the month of August. Activities included maintenance and repair of equipment, cutting side ditches along several roads and grass mowing at township building and sewer plant. The road crew also completed the Hilltown Road project. The Flohrs Church road repaired area at the bridge to the lodge was double sealed. The road crew foreman met with Centurylink and their cable installer at Goldenville Rd. to discuss repairs and seeding that needed to be done after they completed laying their cable.

MOTION by Supervisor Sharrah, seconded by Supervisor Arrison stating that, contingent upon receipt of the insurance certificate naming Franklin Townshot as an insured, a letter be sent to PennDot acknowledging that they are aware of the Iron Cross Bicycle Event to be held September 29, 2013. Storage of Explosives Ordinance – the Supervisors reviewed the results of the hearing held just prior to the regular meeting concerning the Ordinance.
MOTION by Supervisor Arrison, seconded by Supervisor Sharrah that the Storage of Explosives Ordinance be tabled until the October meeting and that another hearing be scheduled and advertized for October 3, 2013 at 6:00 P.M. Motion carried, 2-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Arrison that the Storage of Explosives Ordinance be sent to the Township Planning Commission and to the Adams County Planning Commission with a cover letter explaining that the only change is to change the setback from 500 feet to 100 feet. Motion carried, 2-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Arrison to authorize attendance at the Adams County Association of Township Officials conference on November 13, 2013 by any of the Supervisors that wish to attend. Motion carried, 2-0.
GUESTS
Pat Schindel said she has a property at 1291 Mt Carmel Road where the pipe that runs under the shoulder in the right-of-way is rusted. She said she received a message from the road crew foreman that it is her responsibility to clean it out and make any necessary repairs since it is for her property. Ms. Schindel feels that it is a pipe that for which the township should be responsible and requested the Supervisors to take care of it. The Supervisors told her they would check with the foreman to investigate the problem.
Raymond Slothour questioned when the Sprint/Nextel cell tower will be constructed on the Irvin property. Gil Picarelli told him that all approvals have been issued and that it is now up to Sprint/Nextel to decide if they will build the tower.

Supervisor Arrison read the Buchanan Valley Fire Department Report. Buchanan Valley had 12 calls for August 2013 with a total of 187 calls for the year. Brush 27 is currently at the vendor getting safety upgrades and a new hose, but is expected back in service in a week. The project was paid in full with a safety grant.
Supervisor Arrison read the Cashtown Fire Department report. Cashtown had 14 calls for September 2013. There were 10 responses in Franklin Township, 3 in Cumberland Township and 1 in Tyrone Township. They will be holding a 450 Club Feed/Drawing on Saturday, October 19th.
Supervisor Crushong read the road report for the month of September. Activities included widening a side ditch section of Hilltown Road, cutting side ditches along several roads and grass mowing at township building. L.S. Lee installed guiderail at the culvert on Hilltown Rd. The road crew also went to LTAP class and repaired and straightened delineators along various roads. The new township small dump truck (unit # 8) arrived equipped with snow plow and spreader. It will replace unit # 6 which is to be offered for sale. New blacktop was installed in the salt/antiskid shed. Stop signs stolen from Mountain/Plantation Road and Mountain/Buchanan Valley Road were replaced.
OLD BUSINESS
Ordinance for Storage of Explosives – the second hearing to review the proposed ordinance that provides regulations for the storage of explosives was held just prior to the regular meeting. As a result of the hearing, requests were made by the Supervisors to include language in the ordinance that requires fencing around the magazines and adds additional footage to the setback requirements.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to table the ordinance until requested changes in ordinance are completed. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve the advertisement of the Board’s intention to vote on the proposed ordinance at the next Supervisors’ meeting in the Gettysburg Times. Motion carried, 3-0.
NEW BUSINESS
The Township Secretary attended the group meeting held in Biglerville to determine which waste hauler would be awarded the new contract for 2014-2016. The Supervisors had expressed a desire to remain with Parks if possible, but a review of the bids indicated that the lowest bid was submitted by Advanced Disposal. The bid they submitted was for an annual fee of $116.28 for normal waste and $40.92 annually for recycling.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong that the contract for waste disposal for 2014-2016 with an optional 1 year extension be awarded to Advanced Disposal. Annual fees are to be $116.28 for normal waste and $40.92 for recycling. Motion carried, 3-0.
Surplus Equipment Sale – The road crew foreman submitted a list of items to be considered for sale by the township. The Supervisors reviewed the list of items:

MOTION by Supervisor Crushong, seconded by Supervisor Sharrah that the equipment listed above be advertized for sale in the Gettysburg Times with sealed bids due to the Township Office by 2:30 p.m. on November 7th. Bids are to be opened at the Board of Supervisors meeting on November 7, 2013. Motion carried, 3-0.
Supervisor Arrison reported on a meeting he attended with attorney Dan Cohen and a number of other townships to discuss having Mr. Cohen represent them as a group in negotiations with Comcast Cable regarding their contracts. Items to be covered include potential grants, formulas for township revenues from Comcast and provisions for Comcast to provide Internet and TV service for the townships and their fire departments.
Participation as a group would result in reduced fees for Mr. Cohen to act as the townships’ representative.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve entering a contract with Dan Cohen to participate with a group of other townships in negotiations to maximize revenue from Comcast Cable. Motion carried, 3-0.
The Township’s Pension Administrator has prepared the Minimum Municipal Obligation Approval for the 2014 Pension Plan. The Secretary sent the document to the Supervisors for review.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah to sign the Minimum Municipal Obligation Approval for the 2014 Pension Plan. Motion carried, 3-0.
Township resident Terry Culp presented a request for replacement of the Cashtown signs that used to be at each entrance to the town. He said that the only remaining one on Old Route 30 is in bad shape. He had researched information and found new signs could be purchased for $87.00 each from U.S. Municipal. The signs would include the explanation of the township name as was on the originals.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah to purchase 4 Cashtown signs from U. S. Municipal and install them in 2014. Motion carried, 3-0.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong that Trick or Treat for Halloween be scheduled on Thursday, October 31 from 6:00 p.m. to 8:00 p.m. Motion carried, 3-0.
GUESTS
Wayne Haifley asked if road projects have been selected for the 2014 budget yet. He requested that, if not already on the list, Foxhill Road be added to the list. Supervisor Sharrah explained to Mr. Haifley that there is a 5 year master list that determines the rotation of when work is done to the roads. He said that the Supervisors will check the list and that final determinations will be made by the end of November. Ken Ketterman stated that Foxhill Road may have been missed because he said it has been many years since any work has been done on it.
Melanie Thomas had a question about the report in the Gettysburg Times that the Board is considering the storage of explosives ordinance. She asked several questions about the property, all of which were answered by Solicitor Davis.

Nick Colonna announced there will be GIS demonstrations held November 20th at 19 Baltimore St, Lower Level.

URS, engineer for PAWC reported that Adams County had some issues with the 537 plan that have been resolved.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve the 537 plan submitted by URS for PAWC with the modifications recommended by Adams County. Motion carried, 3-0.
Ken Ketterman and a group representing the residents of Foxhill Road presented a formal request to the Supervisors that the 2014 budget include their road for maintenance work to be done next year. Supervisor Arrison told them that money for Foxhill Road is in the proposed 2014 budget. Roadwork is contingent upon the Township receiving all of the estimated State monies. Wayne Haifley wanted to make sure the work would be done in 2014 and John Newell requested how they will know. Supervisor Arrison told them the approval is completed when the budget is approved.
A resolution supporting changes in the Prevailing Wage associated with the Transportation bill in the state senate was proposed.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah to approve Prevailing Wage Resolution 2013-02. Motion carried, 3-0.
A resolution proposing the establishment of a fire tax to support the volunteer fire companies servicing Franklin Township as first responders was proposed. Joel Riddlemoser reqested how the tax distribution would work. The supervisors summarized the tax as follows:
Fire Departments covered and percentage of total to be received:
Cashtown Community Fire Dept – 57.27%
Buchanan Valley Fire Dept – 32.89%
Arendtsville Fire Dept – 9.85%
Solicitor Davis stated that funds will be distributed via a claims process requiring supporting fund documentation from the fire departments. The reporter from the Gettysburg Times asked if a special hearing is required to be held prior to adopting the tax. Solicitor Davis said this is not a requirement.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve Fire Tax Resolution 2013-03. Motion carried, 3-0.
The Supervisors presented the proposed budget for 2014. The proposed budget, including the new Fire Tax Resolution, will be available for viewing at the Township Office.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve advertisement of the 2014 Budget in the Gettysburg Times. Motion carried, 3-0.
A request was received from organizers of the North-South Marathon to approve road use during their event to be held April 27, 2014. The secretary noted that all required documents have been received.

GUESTS
Melanie Thomas,the reporter from the Gettysburg Times questioned what the setback measurements in the final proposed explosives storage ordinance received from Solicitor Suhr. Solicitor Davis confirmed that it was 300 feet from the road and 100 feet from the side property lines.
Pat Schindel questioned when the Township was going to repair draintile for her property on Green Ridge rd. Supervisor Arrison told her that the draintile in question is her driveway tile and it is her responsibility to take care of it. Ms. Schindel replied that other driveway tiles have been repaired by the Township. Supervisor Sharrah assured her that the Township has never been responsible for repair of driveway tile and does not do repairs. She questioned repairs done further up her road using hot mix. The Board said they would investigate.
Bruce Strasbaugh submitted the Cashtown Community Fire Department financial statement to Supervisor Arrison along with the Fire Dept’s thanks for Township support.

The meeting, held at the Franklin Township Municipal Building, was called to order at 7:00 p.m. by Chairman Jerry Arrison.
The pledge of allegiance was recited by all in unison.
APPROVAL OF MINUTES
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve the November 2013 meeting minutes, as pre-read by the Supervisors. Motion carried, 3-0.
APPROVAL OF BILL LISTS
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong, to approve Bill List # 11, General Fund checks 31786-31843 totaling $58,555.81. Motion carried, 3-0.
PLANS
County of Adams – Emergency Communication System – Sayber Trail – received request for 90 day extension.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah, to approve 90 day extension for plan for County of Adams Emergency Communication System Tower. Motion carried, 3-0.
STORMWATER MANAGEMENT PLAN
REPORTS
Supervisor Sharrah read the Code Enforcement Officer’s report. There was 1 cleared violation in November. Active violations include 9 for property maintenance, 4 for building maintenance and 4 for inoperable vehicles. There have been a total of 10 citations issued so far this year.
The Zoning Officer’s report was not received in time for the December meeting. (Secretary’s note – report received subsequent to meeting and is on file in the office).
Supervisor Arrison read the Cashtown Fire Department report. Cashtown had 24 calls for November 2013. There were 14 responses in Franklin Township, 2 in Cumberland Township, 1 each in Hamiltonban, Straban, Menallen, Butler, Mount Joy, and Highland Townships, 1 in Bonneauville Boro and 1 in Fayetteville Boro in Franklin County.
No report was received from the Buchanan Valley Fire Department.
Supervisor Crushong read the road report for the month of November. Activities included maintenance and repair of vehicles, road repairs on Fox Hill and replacement of damaged guide rail at Winding Rd and Tillietown Rd. Several holes on dirt roads were filled with 2 RC stone. Repairs to the salt/anti-skid shed were completed and anti-skid mixture was done for initial winter weather road treatments. Treated roads with anti-skid two times at the end of the month.
Supervisor Arrison did not have a report for the November COG meeting, but said that the minutes are available for anyone who wishes to see them. He did report that there is a 2-1-1 number available to anyone needing human services information and/or referrals.
SEO Gil Picarelli said that in future when KPI receives stormwater management plans, they will scan them quickly to see if there are any zoning issues and forward them to Wilbur so that he can respond to them in time for the planning commission meeting at which the plans will be reviewed.
OLD BUSINESS
URS, engineer for PAWC had submitted plans for a Minor 537 Revision that was tabled last month awaiting county comments. All reviews done and planning commission approved the resolution at their November meeting.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to approve Resolution 2013-04 for Minor Act 537 Revision. Motion carried, 3-0.
The Supervisors presented the proposed budget for 2014 in November. The proposed budget included the new fire tax and was approved for advertising and public viewing.

NEW BUSINESS
The Secretary requested that the Supervisors’ review and approve advertising of the dates for the reorganizational meetings in January. The Board of Supervisors will meet Monday, January 6th at 1:00 P.M. and the township Auditors will meet Tuesday, January 7th at 6:30 P.M.
MOTION by Supervisor Sharrah, seconded by Supervisor Crushong to advertise the reorganizational meetings to be held in January. Motion carried, 3-0.
A request was received from Cashtown Community Fire Dept. for the township to contribute the $500 approved in the 2013 budget to help cover costs for them and Buchanan Valley Fire Dept to provide fire safety education at Franklin Township Elementary School. They requested that $200 be donated to Buchanan Valley Fire Dept. and $300 to Cashtown Community Fire Dept.
MOTION by Supervisor Crushong, seconded by Supervisor Sharrah to approve issuing checks for $200 to Buchanan Valley Fire Dept and $ 300 to Cashtown Community Fire Dept to help cover expenses for the fire safety day held at Franklin Township Elementary School. Motion carried, 3-0.
The Secretary requested approval to issue all charitable contributions approved in the 2013 budget.

GUESTS
Nancy McGlaughlin questioned whether the 2014 budget is more than the 2013 budget. Supervisor Arrison reported that there are no big differences. She also wanted to know if there are any new taxes. The Supervisors told her there are no changes in taxes other than the addition of the fire tax at the rate of .25Mils.
