Approval of December 2008 Planning Commission Minutes

Revision by Bush to the Marsh Creek, LLC notes – should be PA Fish & Boat Commission instead of U.S. Fish & Boat Commission.

MOTION by Robinson, seconded by Crushong to approve the revised December minutes.  Motion carried.

They are purchasing a small piece of property from an adjoiner (Theodore Jones) so they can have adequate road frontage for a driveway so they can subdivide their tract of land.  They will need a shared driveway agreement.

 

Regina Pritt – Sketch – Old Route 30 – Ag Zone

Two-lot subdivision, each going to an adjoiner.

 

Randy & Lori Misner – Sketch Plan – Buchanan Valley Road

The Misners, owners of the address at 1395 Buchanan Valley Road and the Misner Family Farms, located at 1465 Buchanan Valley Road would like to use the existing driveway that provides access to 1465 Buchanan Valley Road and execute a shared driveway agreement.

MOTION by Robinson, seconded by Crushong to recommend to the Supervisors that they grant approval of a shared driveway agreement.

 

SPECO – Preliminary plan – Poplar Springs Road – Ag Zone

Three single-family residential lots from an existing 24.880 acre lot.  Note on the plan states to the effect that 18.310 acre lot remaining on two deeds.  There is a question on how much land they have left to develop.  The Solicitor should give us an interpretation on whether the two deeds can be combined.  We need to see a copy of the agreement in writing.

MOTION by Robinson, seconded by Spence to table the plan pending Solicitor interpretation and viewing the agreement.  Motion carried.

 

Old Business

Residential Windmills – There are various ways we could handle residential windmills.  Some examples are: let the UCC control it, allow the “Use” in certain zones, have an ordinance to cover windmills, etc.  We have asked KPI Technology, Inc. to bring a recommendation to the next meeting on how we should proceed.

MOTION by Spence, seconded by Robinson to approve the January minutes.  Motion carried.

Lloyd Adkins – Sketch plan – Seven Stars Road – Industrial and Ag zones

Lot 1 – 41.9 +/- acres, Lot 2 – 4.2 +/- acres, Lot 3 – 3.2 +/- acres

They are not sure where they can get clear sight distances for Lot 3.  Lot 3 does have a panhandle to the road but the sketch shows another proposed driveway access to the highway.  There are no speed limits posted on this road.

They will need to have someone determine the location where clear sight distances could be obtained.

 

Theodore & Barbara Jones – Preliminary/Final – Orrtanna Road – Residential zone

They want to subdivide a .085 +/- acre lot (Lot 2) from an existing 1.731 +/- acre parcel.  Lot 2 will be conveyed to an adjoiner, Matthew Wentz.

No Adams County comments have been received.

MOTION by Bush, seconded by Robinson to table the plan pending review of Adams County comments.  Motion carried.

 

Theodore & Barbara Jones  – Planning Waiver and Non-building Declaration

MOTION by Robinson, seconded by Schindel to approve the waiver.  Motion carried.

 

Matthew & Montana Wentz – Preliminary/Final – Orrtanna Road – Residential zone

They would like to subdivide a 3.956 +/- acre lot (Lot 2) from an existing 5.691 +/- acre parcel.  No Adams County comments have been received.

MOTION by Robinson, seconded by Schindel to table the plan pending review of Adams County comments.  Motion carried.

Robinson read KPI Technology’s comments dated 1/27/09 and Adams County comments dated 2/4/09.

MOTION by Schindel, seconded by Williams to recommend approval of the plan pending resolution of KPI Technology’s comments and the township should ensure that the Jones subdivision and applicable deeds are recorded before the Wentz plan is approved and recorded.  Motion carried.

 

Regina O. Pritt – Preliminary/Final – Old Route 30 –

The plan was tabled due to no Adams County comments being received.

 

Lloyd Adkins Seven Stars Road – Industrial and Ag zones

Lot 1 – 41.9 +/- acres, Lot 2 – 4.2 +/- acres, Lot 3 – 3.2 +/- acres

Mr. Adkins presented a letter dated 2/11/09 from Officer Juanita Larmer stating the safe running speed for the road should be 40 mph.

The Supervisors would need to know if the driveways meet the sight distances at the locations where they determined the safe running speed.

 

Old Business

 

Residential Windmills –We should ask our Solicitor for his suggestions on how to handle personal residential windmills.  Cindy Smith will ask Wilbur Slothour to come to the Supervisor’s meeting to discuss the issue.

MOTION by Williams, seconded by Schindel to recommend that it should be permitted in all zones providing certain setbacks are met and that there is an inspection process involved.

 

New Business

 

Posting highway signs – If a developer has the speed limit determined to be reduced/adjusted then it is up to the developer to be responsible for purchasing the posted signs.

 

Addition to Ag Security Area #1

Mary Grimes has 3 parcels that they would like added to ASA #1.

MOTION by Spence, seconded by Schindel to recommend approval of this addition to ASA #1.  Motion carried.

 

Dave Kuhn would like to know the best way to subdivide his father’s home.  Question on where to place the driveway and setbacks.  The current driveway is very close to the house.  The home will have public sewage.  He will have to change the location of the driveway to meet regulations.

Approval of April 2009 Planning Commission Minutes

MOTION by Schindel, seconded by Robinson to approve the April minutes.  Motion carried.

Donald Kimple – sketch plan – Church Road

He would like to subdivide approximately 2 acres from land owned by his daughter. Suggested he have perc tests done on the proposed site.

 

Ron Bennett – Sketch plan – Bottom Road

He would like to have two 5 +/- acre lots subdivided off of a 130-acre parcel that is currently in Land Conservancy.  He would need to have two 25’ panhandles and is missing about three to four inches.   There is also a storage shed near one of the panhandles.

Suggested they go to the Supervisor’s meeting and ask about having them grant a simple use of the panhandles and grant a waiver for the missing 3 to 4 inches.

Gil Picarelli will investigate the storage-shed setbacks to determine if the setback is 10’ or 25’.

 

Keystone Farms – Preliminary/Final – Oak Tree Road – Ag Zone

Subdivision of a 48.722 +/- acre tract of land into three (3) single family residence lots and the remainder to be a Farm Lot.

Issues from KPI Technology’s comments dated May 5, 2009 are the following:

  1. There are grading activities proposed on the Six property, with no indication of grading easements or permissions.
  2. The Township Solicitor should review and comment on the proposed joint use driveway agreement between lots 4, 5, & 6.
  3. An executed owner’s acknowledgement needs to be provided.
  4. An estimate of Public Improvements Bonding should be prepared and submitted.

 

MOTION by Robinson, seconded by Schindel to recommend approval of the plan pending resolution of the above comments.  Motion carried.

 

Matthew D. Wentz – Preliminary/Final – Orrtanna Road – Residential zone

Subdivision of 3.956 +/- acres from and existing 5.691 +/- acre parcel.

Issues from KPI Technology’s comments dated May 6, 2009 are the following:

  1. It appears that a shared driveway will be utilized for the two proposed lots. The Township Solicitor should review all agreements for comment.
  2. An executed owner’s acknowledgement needs to be provided.

 

MOTION by Williams, seconded by Crushong to recommend approval of the plan pending resolution of the above comments.  Motion carried.

 

Regina O. Pritt – Preliminary/Final – Old Route 30 – Ag Zone

Subdivision of a 1.407 +/- acre tract of land into three lot additions with no remainder. Parcel A to be conveyed to William Pritt and Parcels B & C to be conveyed to Eddie Pritt.

Reviewed KPI Technology’s comments dated 5/6/09.  The plan is considered nonconforming because existing buildings are located in the building setback line; however, we do not believe this proposal will have either a positive or negative affect on the situation.

Issues are the following:

  1. Non-building declaration is needed.
  2. An executed owner’s acknowledgement needs to be provided.  Also, an executed owner’s acknowledgement for the persons receiving the lot additions needs to be provided.

Electronic changeable text signs – We should consider addressing these signs due to an increased demand in the township.  Gil Picarelli is going to see if they have any existing ordinance examples for us to use for a discussion at the next meeting.

 

Texas Eastern Transmission, LP / Spectra Energy – They are pursuing a Chambersburg Pick Up and Alternate – It would be near Caledonia to an area near Newman Road.  They are applying for a sediment control plan.

 

Zoning Map – question came up about the last updated zoning map and if it accurately shows the last revision of commercial area near the Cashtown/Route 30 intersection.

The map on the wall of the Township building is outdated and needs to be replaced.

Approval of May 2009 Planning Commission Minutes

MOTION by Schindel, seconded by Robinson to approve the May minutes.  Motion carried.

Ron Bennett – revised Sketch plan – Bottom Road

He would like to subdivide 10 acres off of a 130-acre parcel that is currently in Land Conservancy.  He would need to have two 25’ panhandles and is missing about three or four inches (49.68’ +/-).   Suggested they go to the Supervisor’s meeting and ask the Solicitor about allowing the panhandles since they are only missing a few inches from the minimum size.  The planning commission does not have a problem with allowing the panhandles.

 

Lloyd Adkins – Preliminary plan – Seven Stars Road – Industrial and Ag zones

Would like to subdivide two lots from a 49.296 +/- acre parcel – Lot 1 – which is located in the Ag and Industrial zones.  Lot 2 (3.310 +/- acres) and Lot 3 – (4.393+/- acres) are located in the Ag Zone.

Reviewed the comments from KPI Technology dated 5/5/2009 and Adams County comments dated 5/22/2009.

Issues from KPI Technology’s comments are the following:

  1. A note should be placed on the plan that states Lots 2 & 3 do not have any development rights associated with them and they may not be further subdivided.
  2. The seal and signature of the surveyor responsible for the plan needs to be on sheet 2 of the plan.
  3. An executed owner’s acknowledgement needs to be provided.
  4. It is recommended that a concrete monument be placed along a common lot line for every two lots.
  5. The Township Solicitor should review if rights-of-way (maintenance, service, etc.) are needed for Lot 2 because an electric line will cross Lot 1 and the existing well is located on Lot 1.
  6. The building setback lines need to be shown for Lot 1, at minimum, this can be shown on the Site Map.
  7. A copy of the wetland delineation report should be provided to the Township.
  8. Sewage facilities planning approval is required.
  9. A typical Pennsylvania One Call note needs to be placed on the plan.
  10. It is not understood why the driveway for Lot 1 will be abandoned because there isn’t a new proposed driveway to access the lot.  The developer should clarify the limits of driveway to be abandoned.
  11. The Township should be aware that the proposed driveway for Lot 3 does not have the appropriate sight distance needed; as such, the developer is proposing the driveway be restricted to “no left turns.”  We recommend the Township conduct a field review of the driveway location.  If the Township agrees with the right turning driveway, the developer should be responsible for a traffic control device (sign) to be installed.
  12. The developer needs to be aware that approval of panhandle lots shall be at the discretion of the Township where other options have been evaluated and have been determined to be unacceptable.

 

MOTION by Schindel, seconded by Crushong to table the plan due to the numerous issues that need to be resolved.  Motion carried.

Lee Royer presented a sketch plan – They have approximately 3 acres left to subdivide.  They will need to make three 1-acre lots.

Has about 7.75 acres.  Would like to subdivide off 1 or 2.75 acres. This tract is located off a private road, which comes off of Railroad Lane.  There are already 3 other houses on this private road.  He would have to bring the private road up to township spec in order to do a subdivision.

 

John Cease and Donald Kimple – preliminary/final plan – Church Road

No Adams County comments.  A representative from Bert & Associates was present to show us the plan.  We saw the Declaration of Easement letter, dated 7/24/2009 from our Solicitor Wally Davis, which stated that he deemed the easement acceptable.

MOTION by Robinson, seconded by Crushong to table the plan pending review of Adams County comments.  Motion accepted.

  • The developer should be responsible for traffic control signage, approved by the Township, to be installed prior to Final Plan signature.

MOTION by Schindel and seconded by Crushong to recommend approval of the plan pending the resolution of KPI’s Subdivision Ordinance comments.  Motion carried.

Will subdivide three single-family residential lots from an existing 24.880 acre lot.

Read Adams County’s comments and reviewed KPI’s comments dated 9/2/09.

KPI’s concerns are the following:

  • The seal of the Surveyor responsible for the plat needs to be indicated on sheet 2 of the plan.
  • An executed owner’s acknowledgement needs to be provided.
  • The Township Solicitor should review the right-of-way agreement associated with sanitary sewer line for comment.
  • Sewage facilities planning approval is required.  A separate letter will be provided to address any issues with the applicant’s planning module.

 

MOTION by Schindel, seconded by Crushong to recommend conditional approval for the creation of lots pending resolution of KPI’s comments.  Motion carried.

 

John Cease and Donald Kimple – Preliminary/Final plan – Church Road

Read Adams County comments dated 8/17/09.  All prior issues with the plan have been resolved.

MOTION by Spence, seconded by Schindel to recommend approval of the plan.  Motion carried.

 

David and Joan Swisher – Sketch plan – Mummasburg Road – Ag Zone

72.66 +/- acres and would like to put a residential addition onto an existing garage.

There are questions about the proper placement and specifications for the driveway.  Gil Picarelli from KPI Technology will do further research and will get in touch with the Swishers.

 

Old Business

Carl Frantz property Commercial Zone inclusion – Hilltown Rd. and US Rt. 30 – After further research by the Township it was discovered that Carl Frantz’s property was never included in the commercial zone during the revision of the zoning map.  Based on the minutes from the January 7, 2004 meeting of the Planning Commission’s Zoning Workshop where a motion was made, seconded and carried, “to include the Frantz property in the commercial zone due to an oversight in our previous mapping of this zone.”      It was decided that a letter should be sent to the Supervisors advising them of this oversight.  Mr. Frantz will be responsible for the costs involved in getting the map change.

 

New Business

Gil Picarelli brought up the idea of getting developers to sign a form that would eliminate the need for a timetable for each plan.  Something like a …perpetual time extension concept.  The plans would still be on a list and there would be stipulations involved.  There were concerns voiced over the idea, so it was suggested Gil discuss this concept with our solicitor, Walton Davis.

 

ASA #4’s 7-year review with modifications

MOTION by Schindel, seconded by Crushong to recommend approval of the revised ASA #4.  Motion carried.

72.66 +/- acres and would like to put a residential addition onto an existing garage.

There are questions about the proper placement and specifications for the driveway.

 

Merry read an email dated 10/7/09 from Gil Picarelli regarding the sketch plan.  Excerpt is as follows:  “We have reviewed the SALDO and spoken with Wally about the proposed duel driveways.  The SALDO does not allow for duel driveways unless circumstances prove that a second access is justified, see section 146-22.A.(2).  However, it is in the Township’s right to grant a modification to Mr. Swisher and permit him to have multiple driveways.  In doing so, we feel Mr. Swisher would not have to bring the current driveway to Township private road specifications.  However, Mr. Swisher would need to submit a Land Development plan for the project to the Township for its approval.  Also, the Township should decide if they are going to require that Mr. Swisher install the second driveway.”

MOTION by Robinson, seconded by Schindel, to recommend to the Supervisors that they allow a second driveway on the plan.  Motion carried.

Northwest Comprehensive Plan – The Public meeting was held last week about the Comp Plan.

MOTION by Bush, seconded by Schindel, to recommend that the Supervisors adopt the Northwest Comprehensive plan.  Motion carried.

Frank Gerhardt – The Village of Laurel Run – Special Exception – US Rt. 30 – Open Space Zone

Mr. Gerhardt and Robert Sharrah were present to explain their request for a special exception.  Would like to build 4 duplexes and 2 singles residential structures directly across the street from other residences.   They are requesting an expansion of the existing continual care retirement community.

MOTION by Robinson, seconded by Crushong to recommend approval of the special exception by the Zoning Hearing Board.  Motion carried.

Approval of November 2009 Planning Commission Minutes

MOTION by Robinson, seconded by Schindel to approve the November minutes.   Motion carried.

 

Guests:      

 

Rob Barbour – Sketch plan –  Crossroads Restaurant – US Rt. 30

Mr. Barbour would like to subdivide the 50,000 sq ft (+/-) lot where the restaurant is currently located.  The area around the restaurant and parking lot would be approximately 20,000 sq ft.  He is hoping to sell this lot.  No problems seen with the sketch.  Suggested he have a surveyor draw the plan to accommodate the road frontage requirements.

 

Kevin & Diane Thomas – Sketch plan – off of Old Rt. 30

They would like to subdivide a small section off to an adjoiner to clean up some lot line issues.  No problems seen with the plan.
